WHEREAS, the current Code of Ordinances of the City of Clearwater contains no procedure to be utilized in handling requests to conduct parades + and other similar events in the City; and WHEREAS, a need nexists to provide such a procedure and thereby provide a mechanism whereby the Chief of Police can address such requests and determine that the safety of all those involved is protected; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 19, Streets and Sidewalks, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is amended by enacting a new Article III, Parade Permit, to read as follows: ARTICLE III. PARADE PERMIT. Section 19-34. Permit Requirement. No person shall engage in, participate in, aid, form or start'. any parade, unless a parade permit shall have been obtained for such purpose from the Chief of Police. `. Section 19-35. Application, Contents. A person seeking the issuance of a parade permit required by this article , shall file an application with the Chief of Police, on forms provided by the Chief of Police, which application shall comply with the following requirements: (a) Filing period. An application for a parade permit shall be filed with the Chief of Police not less than fifteen (1S) days before the date on which it is proposed to conduct the parade. (b) Contents. The application for a parade permit shall contain the following information: (1) The name, address and telephone number of the person seeking to conduct the parade. (2) If the parade is proposed to be conducted for, or on behalf of or by an organization, the name, address and telephone number of the headquarters of the organization and. of the authorized and responsible head of the organization. (4) The date the parade is to be conducted. The application shall be signed by the applicant and notarized. (d) Late applications. The Chief of Police, where good cause is demonstrated, shall have the authority to consider any application for a parade permit which is filed less than fifteen (15) days before the date the parade is proposed to be conducted. Section 19-36. Fee A fee of twenty-five ($25.00) dollars to cover the costs incident to processing an application for a parade permit shall be paid by the person applying for the parade permit at the time of the filing of the application. The City Manager shall have the right to waive the fee provided for herein for cause; as used herein, cause shall mean where the applicant demonstrates that such applicant lacks the ability to make the payment and imposing the fee would result in a severe hardship. Section 19-37. Financial responsibility. (a) The applicant for a parade permit and any other persons, organizations, firms or corporations on whose behalf the application is made by filing the application do represent, stipulate, contract and agree that they will jointly and severally indemnify and hold the City harmless against injury to or the death of persons arising out of or resulting from the issuance of the permit or the conduct of the parade or its participants. (b) In addition to the requirements of subsection (a), no parade permit shall be issued unless the applicant therefor shall obtain a comprehensive general liability insurance policy, issued by an insurance company authorized to do business in the State, with coverage that includes the assembly area, the parade route, the disbanding area of the parade and any other area and the participants of the parade. The City shall be named as an additional insured on such policy. The requirement for satisfactory proof shall be complied with by presenting the policy or a copy of the policy to the Chief of Police. (d) The requirements of subsections (b) and (c) of this section k .s r ?? w ,.!,fA r w , shall not be applicable to parades composed of pedestrians only and not including any vehicles or animals. If motor F?: °.? vehicles are to be included, evidence of public liability insurance with the same limits on the vehicles may be accepted in lieu of the insurance required in subsections #'f f (b) and (c). (ro :?`r Section 1936. Standards for issuance of permit. (a) The conduct of the parade will not substandially interrupt the safe and orderly movement of other traffic contiguous to its route. (b) The conduct of the parade will not require the diversion of so great a number of police officers of the city to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection to the city. (c) The conduct of the parade will not require the diversion of so great a number of ambulances as to prevent normal ambulance service to portions of the city other than that to be occupied by the proposed line of march and areas contiguous thereto. (d) The concentration of persons, animals and vehicles at assembly points of the parade will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to the assembly areas. (e) The conduct of the parade will not interfere with the movement of fire-fighting equipment en route to a fire. (f) The conduct of the parade is not reasonably likely to cause injury to persons or property, to provoke disorderly conduct or create a disturbance. (g) The parade is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays en route. Section 19-39. Time for action on application; notice of denial. The Chief of Police shall act upon the application for a parade permit within three (3) days after the filing thereof. Any person aggrieved by the denial of a parade permit pursuant to this article shall have the right to appeal the denial to the city manager. The appeal shall be taken within 48 hours after receipt of the notice of denial. The city manager shall act upon the appeal within 72 hours after its receipt. Section 1 Contents of permit. ;1 . Each parade permit issued pursuant to this article shall 1 state the following information: parade; a The date of the (b) The starting time and termination time of the parade; (c) The portions of the street to be traversed that may be occupied by the parade; i (d) The number of persons, animals and motor vehicles that will be in the parade; ?s (e) Such other information as the chief of police shall find necessary to the enforcement of this article. Section 19-42. Possession of parade permit. The parade chairman or other person heading or leading a parade shall carry the parade permit issued pursuant to this article upon his person during the conduct of the parade. Section 19-43. Revocation. The chief of police shall have the authority to revoke a parade permit issued pursuant to this article upon violation of the standards for issuance prescribed in this article. Section Z. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall nota£fect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Any person, or persons, firm or corporation or association of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisoned in Jail for not exceeding sixty (60) days or by both such fine and imprisonment in the discretion of the Judge. -4- Ord'. 02074 1/17/80 71- .
