ORDINANCE NO, 2073
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1979, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on October 4, 1979, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established, which hearing was continued until November
1, 1979, and thereupon completed; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation o£
all evidence presented at the said continued public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 1979, 11 as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as RPD - Residential Planned Development with a
Maximum Density of 2 Units per Acre
Lot A according to the corrected map of Harbor Oaks, as
recorded in Plat Book 3, page 65 of the Public Records of.
Pinellas County, Florida.
AND
Lots 2, 3, 5, 6, 7 and 8, Shore Oaks Subdivision, according
to the map or plat thereof as recorded in Plat Book 8, page
35 of the Public Records of Pinellas County, Florida.
AND
The South 146 feet of Lot 2, Block 6 of Starr & Saveryl s
Addition to Clearwater, Florida, according to the map or
plat thereof as recorded in Plat Book It page 97 of the Public
Records of Hillsborough County, Florida, of which Pinellas
County was formerly a part.

of Shore Oaks Subdivision and West of the West line of Lime
Street projected South as vacated in Deed Book 1573, page
262, of the Public Records of Pinellas County, Florida,
LESS AND EXCEPT any portion of the above described real
property zoned Aquatic Land.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500.00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation ina ecordance
with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 7, The provisions of this ordinance shall take effect
immediately upon its passage.
