ORDINANCE NO. 2071
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING THE ZONING ATLAS OF THE CITY OF CLEAR-
WATERo FLORIDA, 1979, AS AMENDED, BY RECLASSIFYING
AND ZONING CERTAIN PROPERTY AS DESCRIBED HEREIN;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE,
WHEREAS, on November 1, 1979, the City Commission of the City of

Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the Zoning Atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, the City Commission has fully considered the recom-
mendations and report of the Planning and Zoning Board relative to the
certain proposed changes to the Zoning Atlas; and
WHEREAS, certain of the proposed changes and amendments to the
Zoning Atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That for the following reasons related to health, safety and
welfare, it is hereby declared to be necessary to exercise the police power
possessed by the City of Clearwater:
1. That Chapter 163 of the Florida Statutes established that
zoning is an appropriate and essential means of implementing
a comprehensive plan and that both the plan and zoning of the
land are required to be consistent with each other;
2. That the amended zoning classifications more nearly reflect
the City's Comprehensive Plan and the policy objectives which
are a part of that Plan;
3. That the amended zoning classification better reflects the
current development characteristics as measured by type of
use, density and building height witnessed to the area reclassified;

4. That the South Greenwood area, because of its geographic
location and proximity to the downtown area, is uniquely
situated to serve the residential needs of the inner-city
residents;
S. That the established commercial corridors along Ft. Harrison
and Missouri Avenues adequately serve and define the largely
residential character of the South Greenwood neighborhood;
6. That the City has, through its Housing Assistance Plan and
Community Development Block Grant program, established
the South Greenwood neighborhood as a target or strategy
area wherein the expenditure of public monies has been
committed to preserve and rehabilitate the residential character
of the neighborhood;
7. That the Neighborhood Housing Services program, endorsed
and supported in part by the City, has selected the South
Greenwood neighborhood as that area of the City wherein its
efforts to preserve and upgrade the quality of residential
housing stock will be concentrated; and
8. That by reason of these factors the property set forth in Section
2 of this ordinance should be rezoned.
Section 2. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning
Atlas of the City of Clearwater, Florida of 1979", as amended, is amended
to indicate that fact as hereinafter set out:
Zoned as PS - Professional Services District
Lots 1 through 11, inclusive, Block 29, Magnolia
Park Subdivision, according to the map or plat thereof
as recorded in Plat Book 3, page 43 of the Public
Records of Pinellas County, Florida.
AND
Lots I through 6, inclusive, Greenwood Hill
Subdivision, according to the map or plat thereof
as recorded in Plat Book 11, page 74 of the Public
Records of Pinellas County, Florida.

are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500.00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section 6. Notice of the proposed enactment of this ordinance has i . P1
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 7. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
