WHEREAS, the City of Clearwater as Lessor and owner of the Clearwater Executive Airport, located at 1000 Hercules Avenue North, has a proprietary interest in said airport; and WHEREAS, an airport proprietor has the right to adopt and enforce reasonable regulations at its airport, including the establishment of designated traffic patterns for take-offs and landings; and WHEREAS, the establishment of traffic patterns at an airport increases the health, safety and welfare of persons residing in surrounding neighborhoods as well as the safety of pilots and passengers of aircraft utilizing the airport; and WHEREAS, the establishment of traffic patterns at an airport will also help minimize the volume of noise in surrounding neighborhoods caused by the taking off and landing of aircraft; and WHEREAS, the State Departmenf of Transportation and the Federal Aviation Administration concur in the above findings and recognize the right of the City of Clearwater to establish traffic patterns at said airport; and .m , ]f .o 1 i PF:t:at s4'.Y R•.. +' ? i•,. ci'r.. ..,? .. n ty :l:.r??? ..rii x ?, t i t r<r} ?T: ???N. Section 3-3, Penalty of Chapter 3, Aircraft, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby renumbered as Section 3-4, Penalty. Section 2. Chapter 3, Aircraft, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to enact a new Section 3-3, Aircraft traffic pattern for take-offs and landings at Clearwater Executive Airport, to read as follows: Section 3-3. Aircraft traffic pattern for take-offs and landings at Clearwater Executive Airport. The arrival and departing traffic patterns at Clearwater Executive Airport shall be as follows and as set out in diagram attached hereto: 1. Takeoff Runway 33 - To depart area turn right prior to reaching the AMTRAK Seaboard Coast Line Railroad to a heading of 0450 climbing to 2000 feet or three (3) miles before proceeding on course, 2. Takeoff Runway 15 - To depart area a climbing left turn as soon as airspeed permits prior to reaching State Road 590-A and continue climbing on a heading of 045• until reaching 2000 feet before turning on course. 4. Landing Runway 15 - To remain in traffic pattern, make a left climbing turn to enter left downwind at a minimum of 1000 feet AGL (1073 MSL) to insure that the left base leg to final turn is south of the AMTRAK Sea- board Coast Line Railroad. a 5. The landing and take off pattern provided in this section shall control in all cases except where the pilot receives directions from Tampa Approach Control or any Federal air traffic controller to follow a different defined pattern. F Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The provisions of this ordinance shall take effect immediately upon its passage.
