AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 8, ELECTIONS, OF THE CODE OF
ORDINANCES OF THE CITY OF •CLEARWATER, FLORIDA,
1962, TO REQUIRE PERSONS SERVING ON A CITY BOARD,
AUTHORITY OR COMNUTTEE TO RESIGN PRIOR TO RUNNING
FOR OFFICE IN THE CITY OF CLEARWATER; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF'
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; DECLARING THAT A PUBLIC
EMERGENCY EXISTS AFFECTING THE HEALTH, SAFETY
AND WELFARE OF THE CITIZENS OF THE CITY;PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE AND PRO-
VIDING FOR.PROPER NOTICE OF PROPOSED ENACTMENT.

WHEREAS, the current City of Clearwater election code would permit
a person serving on a City created board, authority or committee to continue
to serve without resigning while such person rugs for local municipal
office; and
WHEREAS, it is the desire of the City Commission to require that
persons holding such positions resign prior to running for office in the
City of Clearwater; and
WHEREAS, an emergency exists within the City of Clearwater in that
it is immediately necessary to amend the current election code to provide for
such resignation prior to the commencement of the local election process
thereby avoiding any confusion and preserving the welfare of the citizens
of the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Sub-section (a) of Section 8-54, Candidates' Qualifications,
of Chapter 8. Elections, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended to read as follows:
(a) No individual may qualify as a candidate who holds
another elective or appointive office (salaried or un-
salaried)"-- state, county or municipal -- the term of
which, or any part thereof, runs concurrently with the
term of office for which the individual seeks to qualify.
If seeking to qualify, the individual must resign his current
office at least ten (10) days prior to the first day of the
qualifying period for the office he intends to seek. The
resignation shall have the effect of creating a vacancy in the
office currently held and shall become effective immediately,
but the officer shall continue to serve until his successor is

} ordinance is required in order to provide a consistent election code that r_ .
will be available for use as the qualifying process starts, and by reason of
such fact an emergency is hereby declared; and that this ordinance shall be
in full force and effect immediately upon its passage. This ordinance shall
automatically expire ninety (90) days from the date of its passage unless
the ordinance is submitted during such time for consideration as a non-
emergency ordinance.
Section. 6. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
