AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING APPENDIX A, ZONING, OF THE CODE OF
ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA,
1962, TO PROVIDE NEW DEFINITIONS RELATING TO
NONCONFORMING USES; TO PROVIDE NEW CODE REQUIRE-
MENTS TO GOVERN EXISTING NONCONFORMING USES;
TO PROVIDE FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. That paragraph fifty (50) of Article II, Appendix A,
Zoning of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is hereby amended to read as follows:

or land that does not comply with the Permitted Use or Special
Exception provisions for the zoning_di_strict in which such use
is situated, and where the use existed legally on the effective
date of the applicable provisions of the Zoning Ordinance.
50. 1) Nonconformity - Any lot, structure, use or other
feature of the property regulated under the provisions of
this ordinance which does not comply with the requirements
therefor, but which situation existed legally on the effective
date of the applicable provisions of the Zoning Ordinance.
(50.2) Nonconforming Lot - A lot of record as established
under Section 3, 04 of this Ordinance, which lot does not
conform with the minimum lot area and/or width dimensions
required for a specified use in the zonin .district in which it
is situated and where the owner of said lot does'not own an
adjoining unimproved property, the subdivision of which
would allow the creation of one (1) or more conforming lots.
(50. 3) Nonconforming Structure - A "building or structure which
does not conform to the requirements for location or dimension
of such building or structure in the zoning district in which it
is situated as regards minimum yard dimensions, maximum
height or maximum lot coverage.
Section 2. That Section 35.08 Nonconforming uses of Article XXXV,
Administration and Enforcement, Appendix A, Zoning, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
to read as follows:

Intent -
(a) Within the districts established by the Zoning Ordinance
or amendments that may later be adopted, there exist lots,
structures, uses of land and characteristics of use which
were lawful before the Ordinance was passed or subse!uentl
amended, but which would be prohibited or otherwise restricted
under the terms of the Ordinance or its future amendment. It
is the intent of this Ordinance, except as otherwise provided
herein, to permit these legal non-conformities to continue
until they are removed, but not to encourage their survival or
replacement. It is further the intent of this Ordinance that
such legal nonconformities shall not be enlarged upon, expanded
or extended, nor be used as grounds for adding other ?lots
structures, uses or characteristics prohibited elsewhere in the
same district.
(b) Nonconforming Lot - a Permitted Use or Special Exception
otherwise permitted may be established on an nonconformity
lot in such zoning district, ' rovideel that: " ; ,
(1) The owner of said lot owns no adjoining unimproved
land which would create a conforming lot if combined with
the lot which is deficient in area or width; and
(2) Any use established on a nonconforming lot shall
conform to all the otherwise applicable provisions of the
zoning district in which it is located. '
c) Nonconforming Structure - A

(2) Any nonconforming structure damaged or destroyed
in excess of fifty (50) percent of the replacement cost of such
structure shall not be reconstructed or replaced except in
conformity with the current applicable provisions ot_
Zoning Ordinance with respect to the structure; and-

additional structure on the existing or any expanded premises;
4 An nonconforming use discontinued for a continuous
period of one Z ear or more shall not thereafter be re-
eatablished and an subsequent use shall be in conformity
with the Zoning Ordinance;
5 An nonconforming use su erceded b a Permitted
or S ecial Exce tion use shall not thereafter be-re-
established: and-
(6) An nonconforming- use damaged or destroyed in
excess of fifty 50 per cent of the replacement cost shall
not be re-established except in conformit with current
applicable provisions o£ the Zoning Ordinance with
respect to permitted uses.

No such nonconforming feature will be expanded,
increased decreased or otherwise chap ed so as

2 No such nonconforming feature once removed or
eliminated shall thereafter be re-established and no such
feature re laced or altered so as to conform will there-
after be altered except in conformity with the current

as a whole, or any part thereof, other than the part declared to be invalid.

Section 4. All ordinances or parts of ordinances in coiiflict
herewith or inconsistent with the provisions of this ordinance are hereby
repealed to the extent of their conflict.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
