ORDINANCE NO. 1988
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING APPENDIX A. ZONING, AND CHAPTER 7,
BUILDINGS, OF THE CODE OF ORDINANCES OF THE CITY
OF CLEARWATER, FLORIDA, 1962, TO PROVIDE A
DEFINITION OF TEMPORARY AND PORTABLE BUILDINGS;
TO PROVIDE A SPECIAL EXCEPTION PERMIT PROCEDURE
FOR USING TEMPORARY AND PORTABLE BUILDINGS; TO
COORDINATE PERMITTING PROCEDURES WITH THE
BUILDING CODE; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR THE
REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED B Y THE CITY COMMISSION OF THE CITY OF CLEARWATER,
FLORIDA:
Section 1. Article II, Definitions, of Appendix A, Zoning of the
Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended by enacting new subparagraphs (58. 1) and 69. 1) to read as follows:
(58. 1) Portable Building: A portable building is any
building or vehicle comprised of one or more
units designed, manufactured or converted for
transportation on the public streets or highways
on wheels, arriving at the site substantially ready
for occupancy, whether for residential, office,
commercial or manufacturing use. Removal of
packing, baffles, and other travel supports;
assembly of units; and connection of or to utilities
shall not be considered,.in determining whether a unit
or units are substantially ready for occupancy. The
towing hitch, wheels, axles, and other running gear
may be removable for the placement of the portable
building and may be reinstalled to permit its further
movement. A mobile home or mobile office including
any doublewide mobile home or office is a portable
building.
(69.1) Temporary Building: A building or structure erected
or placed as a non-permanent installation designed
to serve a temporary need related to construction,
education or emergency housing purposes. Such
temporary location or erection: shall not exempt such
building or structure from meating all applicable
requirements of the Southern Standard Building Code.
Section-2. Article"XXX, Supplementary Regulations Applying To'a
Specific, To Several, or To All Districts of Appendix A, Zoning, of the Code
of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
to enact new Section 30. 12 to read as follows:
Section 30. i2. Temporary and Portable Buildings.
(A) Purpose - It is the purpose of this section to establish

the procedure and guidelines for location of temporary
and portable buildings and to coordinate this process ,
with Chapter 7, Section 504 of the Cide Code of Ordinances.
(B) Permit Required - A Building Permit shall be required for the
location, placement, installation, movement or use of any
temporary or portable building within the City,of Clearwater;
such permit to be obtained consistent with the procedures
of this Section and Section 504 of Chapter 7 of the Code of
Ordinances, Buildings.
(C) Procedure - No temporary or portable building shall be
placed or used on private or public property for any
purpose whatsoever, except upon the grant of a
Special Exception by the Board of Adjustment and Appeal,
or upon successful appeal therefrom, as provided
under Section 35.09 (7) and (8), or as specifically
provided for under paragraph (D) following.
(D) Exceptions - Temporary and portable buildings may be
placed or used for the following purposes upon issuance
of a permit therefor by the Building Inspection Department:

necessary for construction work taking place on the

exceed 8 consecutive days at any one site or premise;
(4) Those used to provide security service, including
living quarters for the security guard, at a construction
site, and only during the period of actual construction;
(5) Those used for public recreation or public health purposes,
which purposes have been previously approved by the City
Manager or the County Health Department;
(6) Mobile home or mobile trailer for residential purposes
in an established mobile home park or trailer park;
(7) Such emergency housing as is deemed necessary in the
public interest and authorized by the City Commission, or
the Mayor or his designee in an emergency situation;
(8) Upon submission and approval of the preliminary site
plan by the City Commission, the Building Inspection
Department may issue a temporary portable building permit
for a temporary portable building to be erected on the
site to be used as a sales or model display office for the
project for which the preliminary site plan was approved.
Location of the temporary portable building on the site
shall be determined by the Building Inspection Department
using the setback line as a guide and such location shall
be specified on the temporary permit. The permit shall
be issued for a time period consistent with Section 504. 1
(b) of the, Code of Ordinances of the City of Clearwater.
Such permit shall automatically expire at the end of the
time period provided in Section 504. 1 (b) or upon completion
of the first unit to be used as a sales office or model
whichever event occurs first.

Section 3. Subsection (8) of Section 35. 09, Board of Adjustment

and Appeal on Zoning, of Article XXXV, Administration and Enforcement, of
the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to enact a new subparagraph (o) to read as follows:
(o) Temporary and Portable Buildings - That the grant of
special exception pursuant to Section 30. 12 can be
acceomplished without substantial detriment to the public
good, without substantial impairment of the general
purpose and intent of the zoning district in which the
use is proposed to be located, and without significant
incompatibility with the general character of the
neighborhood. '
Section 4, Section 504. 1 of Section 7-2, Standard Building Code -
Amendments of Chapter 7, Buildings, of the Code of Ordinances of the City
of Clearwater, Florida, 1962, is hereby amended to read as follows:

Section 504. 1 Permit for Temporary or Portable Building
a) Permit Required - A Building Permit shall be obtained
prior to the installation of„aa -portable building or the
erection of an tem orar structure. Said Buildin Permit
shall specify the a roved use of the portable building or
temporary structure and the temporarXj2eriod over which
the permit is to remain valid. Such Building Permit shall
not be issued fo7r_ any?use not specifically allowed by the
Zoning Ordinance of the Ci orb an approved Special
Exception, as set forth in Section 30. 12 of the Zonin
Ordinance and shall not be issued without prior approval
of the Fire Department with regard to fire safety and
Building Department with regard to structural safet

b Duration of Permit - Except in the case of a temporar
building to be used as a sales or model display office,
all other temporary portable building permits will be
issued for a temporary or portable building as is determined
appropriate by the Building Director, such .period of time
not to exceed 120 days. The building permit for a temporary
sales or model display office shall be issued for a period
of 180 days and can be extended for 3-consecutive - periods
of 180 da s upon due cause being shown at the discretion
of the Building Director. All other temporary ermits may
be extended for up to 2 additional periods of 120 days each,
upon due cause shown, at the discretion of the Buildine
Director.
c) Mcisting Permits - All existing temporary or portable
buildings operating under a temporary permit status
will comply with the provisions of this Section uEon the
expiration of the current period of time for which they
are authorized; or shall be removed within thirt X 3)
days from said ex p iration date.

Section S. Should any section, paragraph, sentences phrase,
clause, or other part or provision of this ordinance be declared by any
court to be invalid, the same shall not affect the validity of the ordinance
as a whole, or any part thereof, other than the part declared to be
invalid. „
Section 6. All ordinances or parts of ordinances in conflict
herewith or inconsistent with the provisions of this ordinance are hereby
repealed to the extent of their conflict.
Section 7. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes,
Section 8. The provisions of this ordinance shall take effect
immediately upon its passage,
