17 O".•"!:y!}X',.«trw,;.•?bl?'.. ,??,?N9)i?F? ?d',?rra • ems:, ??55 .. .,? ? ?:.r''?' 4M In ORDINANCE NO. 1971 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ANNEXING A PORTION OF SECTION 12, TOWNSHIP 29 SOUTH, RANGE 15 EAST, PINELLAS COUNTY, FLORIDA, TOGETHER WITH ALL ABUTTING STREETS, INTO THE CORPORATE LIMITS OF THE CITY OF CLEARWATER, FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION ACCORDING TO THE PROVISIONS OF THE CHARTER OF THE CITY OF CLEAR- WATER, FLORIDA, AND THE LAWS OF FLORIDA; AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING THEREON, ESTABLISHING THE FIRE DISTRICT CLASSIFICATION FOR SAID PROPERTY; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission of the City of Clearwater, Florida, received a sworn petition from Robert Trowell and Barbara J. Trowell, his wife, and Joseph Trowell and Irene Trowell, his wife, requesting the City to annex a certain parcel of real estate described hereinafter, owned by them, into the corporate limits of the City of Clearwater, Florida; and WHEREAS, the City Commission, after due consideration of said request for annexation, at a regular meeting held on April 19, 1979, voted unanimously to accept said request and authorized the proper officials to set up a public hearing thereon for the determination and establishing of fire district classification and to prepare an ordinance to annex said parcel of real estate into the corporate limits of the City of Clearwater in accordance with the provisions of Chapter 171, Florida Statutes; and WHEREAS, on May 17, 1979, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of fire district classification for said real property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. After its evaluation of all evidence presented at a proper public hearing, the City of Clearwater, acting by and through its City Commission, by the authority and under the provisions of Section 171.044, Florida Statutes, hereby annexes into the corporate limits of the City of 1 1 .r ? Clearwater, Florida, and redefines the boundary lines of said City so as ,Ord., #1971,'-, -I- 9/20/79 A0 to include the following described parcel of real property in Pinellas County, Florida, and establishes fire district classification therefor; , From the NE corner of the NE 1/4 of the SE 114 of Section 12, Township 29 South, Range 15 East, run thence S 0.011 19" W, along the Section line, 663. 93 feet for the P. O. B. ; thence continue S 0° 01119" W, along the Section line, 80.01 feet; thence N 89°20'03" W, 206.76 feet; thence N 0°01219" E, 80, 01 feet; thence S 89°20103'1 E, 206.76 feet to-the P. 6. B. ; being a portion of Lot 16, Pinellas Groves in SE 1/4 of Section 12, Township 29 South, Range 15 East as recorded in Plat Book 3, Page 15, of the Public Records of Pinellas County, Florida; together with all abutting streets. The City Commission hereby formally and according to law, accepts the dedication of all casements, streets, parks, plazas, places, rights-of-way and other dedications to the public which have heretofore been made by plat, deed or user within the areas so annexed. The City Engineer, the City Clerk and the Planning Director are directed to include and set out and thow upon the official maps and records of the City of Clearwater the foregoing property and the fire district classification therefor. Section 4. This ordinance and notice of the proposed enactment of same has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes, and Section 171. 044, Florida Statutes. Section 5. This ordinance shall become effective immediately upon its passage and enrollment in the City of Clearwater Ordinance Book and a copy thereof being filed in the office of the Clerk of the Circuit Court of Pinellas County, Florida. In accordance with Section 171. 091, and Section 171. 044, Florida Statutes, a certified copy shall be filed with the Department of State of the State of Florida.
