Y,Yi ?i3 ,L!'135'?`i?a?R. 9??F.. y au'" ???'??dM "?v ox-: 1 a .5 ?• ORDINANCE NO, 1942 AN ORDINANCE OF THE CITY OF CLEARWA TER, FLORIDA, AMENDING CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO ENACT A NEW ARTICLE VI, PUBLIC LOCAL EMERGENCY, TO PROVIDE FOR A PROCLAMATION OF PUBLIC EMERGENCY TO BE ISSUED BY THE MAYOR UNDER CERTAIN CIRCUMSTANCES AND TO PROVIDE FOR IMPLEMENTATION THEREOF TO PROTECT LIFE AND PROPERTY; TO PROVIDE FOR OBEDIENCE TO LAWFUL ORDERS OF A POLICE OFFICER DURING AN EMERGENCY; TO PROHIBIT VIOLATION OF SUCH EMERGENCY PROCLA- MATION; TO AUTHORIZE TEMPORARY POWER TO THE MAYOR TO SUSPEND CODE ENFORCEMENT IN A PUBLIC EMERGENCY; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the recent emergency conditions which occurred within the City, of Clearwater, Florida, by reason of the heavy rains demonstrated that the City of Clearwater needed a more complete procedure to handle such emergencies; and WHEREAS, pursuant to Article VIII, Section 2 b of the Florida Constitution, as implemented by Chapter 166 of the Florida Statutes, the City of Clearwater, Florida, has power to provide for the handling of such emergency conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 2, Administration, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by enacting a new Article VI, Public Local Emergency, to read as follows: Section 2-90. The Proclamation of Public Emergency When there is a riot, mob or body of people acting together intending to commit a felony or to do or offer violence to person or property; or by force and violence-to block or resist the law; or in the event of a flood, hurricane or any similar type of tropical storm, fire or any other similar type disaster affecting life and property and which substantially, impairs the functioning of the City government and its ability to protect the lives and property of the people; then the Mayor of the City of Clearwater is authorized to proclaim the existence of a state of emergency in the City of Clearwater or within any prescribed area or areas of the City. Should the Mayor be unavailable, then the following persons shall have the authority provided to the Mayor in this section, namely, the Vice-Mayor, the City Manager or the Chief of Police in that order. . r rr Ord .01942- . Implementing Proclamation to Protect Life and Property. When a state of emergency has been proclaimed as provided in Section 2-90 of the Code of Ordinances of the City of Clearwater, Florida, 1962, the Mayor, or in his absence or unavailability those persons named in order of succession in Section 2-90, is authorized to issue such proclamation as he deems necessary to protect life and property. Such proclamation or proclamations may include, but are not limited to, the establishment of a curfew; prohibiting the sale of firearms; restricting or prohibiting movement into, out of, or within the area or areas affected; ordering persons living within the area or areas affected out of such area or areas for the preservation of their lives and property; or prohibiting or limiting the assemblage of persons. Section 2-92. Obedience to Lawful Order; Interference. During a state of public emergency proclaimed as provided in Section 2-91 of the Code of Ordinances of the City of Clearwater, Florida, 1962, no person shall fail to obey a lawful order of any police officer, militiaman or other law enforcement officer; and no person shall in any way intentionally interfere with any such police officer, militiaman or other law enforcement officer, or fireman, rescue personnel, medical personnel or other authorized person in the protection or preservation of life or property during the existence of such a state of proclaimed public emergency. Section 2-93. Prohibition. No person shall knowingly violate a proclamation issued in accordance with Section 2-91 of the Code of Ordinances of the City of Clearwater, Florida, 1962. Section 2-94. Temporary Power of Code Suspension. The Mayor, or in his absence or unavailability those persons named in order of succession in Section 2-90, is hereby granted emergency powers where a proclamation has been issued pursuant to Section 2-91 of the Code of Ordinances of the City of Clearwater, Florida, 1962, to suspend enforcement of such provisions of the Clearwater City Codes, 1962, as he deems necessary, including provisions of housing, building, zoning and other code rules and regulations adopted thereunder for a period not to exceed three (3) months or less if terminated earlier by ordinance of the City Commission, in order to facilitate the provisions of emergency housing and service to the victims of disaster. Section 2. All ordinances or parts of ordinances in conflict herewith or inconsistent with the provisions of this ordinance are hereby repealed to the extent of their conflict. Section 3. Should any section, paragraph, sentence, phrase, clause or other part or provision of this ordinance be declared by any, ,court to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid. -2- Ord. #1942 6/7/79 f `'a . -Y • r Section 4. Any person, or persons, firm or corporation or association of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the sum of Five Hundred Dollars ($500.00), or imprisonment in Jail for not exceeding sixty (60) days or by both such fine and imprisonment in the discretion of the Judge. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The provisions of this ordinance shall take effect immediately upon its passage.
