THROWING OR DISCARDING OF TRASH OR OTHER DEBRIS

ENACTMENT; AND FURTHER PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, a review of Chapter 6, Boats, Docks and Waterways
of the Code of Ordinances of the City of Clearwater, Florida, demonstrates
that revisi on is needed in order to provide a more complete code relating
to the dumping, throwing or discarding of oil, waste materials and trash
into the navigable waters surrounding the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA
Section 1. That Section 6-Z3, Water pollution; Control of Waterfront
and Watercraft activities of Chapter 6, Boats, Docks and Waterways, of the
Code of Ordinances of the City of Clearwater, Florida, 196Z, is hereby
repealed in its entirety and the following is hereby enacted:
Section 6-23. 1. Definitions.
When used in this Section or succeeding Sections unless the :'y{
context otherwise requires: MEN
(a) Navigable waters. The term "navigable waters"
means all portions of the navigable waters lying within the
corporate limits of the City of Clearwater, Florida extend-
ing to the high-water mark.
(b) Oil petroleum, petroleum products. The terms "oil"
"petroleum" and "petroleum products" mean oil, petroleum
or petroleum products of any kind or in any form including
fuel oil, oil sludge and oil refuse.
(c) Person. The term "person" means an individual,
partnership, association, corporation, as well as any owner,
master, officer or employee of any vessel.

Section 6-Z3.2. Throwing or Discharging Trash, Debris, etc.,
into Navigable Waters.
It shall be unlawful for any person to place, throw, discharge
or deposit, or cause, suffer or procure to be placed, thrown,
discharged or deposited, either from or out of any ship, barge,
or other floating craft of any kind, or from the shore, wharf,
manufacturing establishment of any kind, any trash, garbage,
debris, acids, timber, logs, lumber, waste human or animal,
or refuse material of any kind or description whatsoever. It
shall further.tbe unlawful for any person to deposit or cause,
suffer or procure to be deposited materials or matter of any such
kind in any place on the bank of any navigable water or on the
bank of any tributary of any navigable water where the same
shall be liable to be washed into such navigable water either by
ordinary or high tide or by storms or floods or otherwise;
provided that nothing herein contained shall extend to, apply to,
or prohibit the operations in connection with the improvement
of navigable waters or construction of public works, considered
necessary and proper by the United States supervising such
improvements or public works, nothing herein contained shall
extend to, apply to, or prohibit the deposit of any material upon
permit issued by the Secretary of Defense of the United States;
nor shall this section be construed as prohibiting or declaring
that to be unlawful which is permissible in accordance with any
United States Code, Section or Federal Regulation now in
existence and in effect relating to navigation or navigable waters.
Section 6-Z3. 3. Equipment of Watercraft.
Any watercraft wihin the territorial waters of the City of
Clearwater, Florida, which is equipped with a marine toilet
or other marine sanitation device, shall comply with perforni-
ancel'standarcls'and-rules and 'regulation's•'contained-in T'itl'e 40
CFR;'Part 140.
Section Z. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repeal ed.
Section 3, Should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Noticeof the proposed enactment of this ordinance has
been properly advertised in a 'newspaper of general circumlation in accordance
with Section 166. 041, Florida Statutes.
