ORDINANCE NO. 1885
AN ORDINANCE TO AMEND CHAPTER 8, ELECTIONS,
OF THE CODE OF ORDINANCES OF THE CITY OF
CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT
ABSENTEE BALLOTS MAY BE APPLIED FOR THROUGH
THE OFFICE OF THE CITY CLERK DURING A ONE YEAR
PERIOD PRECEDING AN ELECTION; TO PROVIDE THAT
THE CITY COMMISSION MAY APPOINT AS MANY ELECTION
BOARDS AS DEEMED NECESSARY TO CONDUCT AN
ELECTION, WHICH BOARDS SHALL BE COMPOSED OF
TWO OR MORE INSPECTORS AND A CLERK; TO PROVIDE
THAT SECTIONS 101.62 THROUGH 101, 6914, FLORIDA
STATUTES, ARE ADOPTED CONCERNING ABSENT VOTERS;
TO PROVIDE FOR THE ELECTRONIC VOTING SYSTEM,
INCLUDING DEFINITIONS COVERING SUCH SYSTEM;
AUTHORIZING USE OF SUCH ELECTRONIC VOTING SYSTEM
FOR THE CONDUCT OF ALL ELECTIONS; TO SET FORTH
THE DUTIES OF THE CITY CLERK IN REGARD TO THE USE OF
SUCH VOTING SYSTEM; TO PROVIDE FOR INSTRUCTION OF
ELECTION BOARDS; TO PROVIDE FOR PROVIDING SAMPLE

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section.l*_ Subsection (3) of Sub-paragraph (c) and Sub-paragraph (d)
of Section 8-1, Time of holding general elections; officers to be alected;
procedures, of Article I, In General, of Chapter 8, Elections, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, are hereby amended to
read as follows:

(d) All individual candidates shall be permitted to have one
watcher in each polling place from the beginning to the
conclusion of each election, as designated in Chapter
101. 131 j3L, Florida Statutes. Watchers must be designated
in writing ten 10 days prior to the election and eerki-&&&
to approved by the city clerk at least five (5) days prior to
the election.
Section 2. . Section 8-6, Election boards--Appointment; qualifications,
of Article I, In General, of Chapter 8, Elections, of the Code of Ordinances of
the City of Clearwater, Florida, 1962, is hereby amended to read as follows;
Section 8-6. Election boards--Appointment; qualifications.
For the purpose of carrying on and conducting general and
special elections, it shall be the duty of the city commission,
at least twenty days prior to holding any general or special
election, to appoint as many election boards as there~ax-e,-
pelUng plac-es _deemed necessary to conduct the election.
Each board shall be composed of th-gea two or more inspectors
and a clerk, all of whom shall be residents and registered
qualified electors of the city. The city commission shall cause
the names of the inspectors and clerks of election, so appointed,
to be published once in a newspaper in the city or posted in a
conspicuous place in the city, at least ten days before the
holding of such general or special elections.

No person who cannot read and write the English language
shall be appointed to the election board.
Section 3. Section 8-18, Absentee voting, of Article I, In General,
of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended to read as follows:
Section 8-18. Absentee voting.
The provisions of Florida Statutes, Sections 101.62 to 4.04,-74).
101.694, inclusive, and any amendments thereto, concerning
absent voters, are hereby adopted and made as much a part
of this Code as if every word, clause, sentence and section
of said sections of Florida Statutes were set out herein.

voting svstem unit for each three hundred (300) registered voters
or fraction thereof,_ qualified to _vote at any deli nated polling
place, who are expected to participate in any election. The city
clerk or authorized represe_ntative_ shall determine the actual number
of electronic voting units to be used in each -precinct at each election.
In determining the number of voting units to be used in each precinct,
the city clerk or authorized _representative shall take into consideration
the traditional voting atterns of each precinct and shall furnish
the number of electronic voting unite necessary-to handle efficiently
the number of anticipated voters in the precinct.

As many electors are admitted to vote as there may be booths
available and no person is permitted under any pretext to come
within fifteen (15) feet of any polling place whatever from the
opening to the closing of the polls, except the sheriff or his deputy,
officially designated watchers, the inspectors, the clerks of election
and the supervisor of elections or his deputy. No sheriff, deputy
sheriff, or city policeman shall enter the polling place without
permission from the clerk, except to cast his ballot.

Section 5. All ordinances or parts of ordinances in conflict
herewith or inconsistent with the provisions of this ordinance are hereby
repealed to the extent of their conflict.
Section 6. Should any section, paragraph, sentence, phrase,
clause or other part or provision of this ordinance be declared by any
court to be invalid, the same shall not affect the validity of the ordinance
as a whole, or any part thereof, other than the part declared to be invalid.
Section 7. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes.
