F ' AN ORDINANCE AMENDING THE ZONING A'T'LAS OF THE x' CITY OF CLEARWATER, FLORIDA, 1978, AS AMENDED, '-: BY RECLASSIFYING AND ZONING CERTAIN PROPERTY AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ' ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT n 1= HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE I OF PROPOSED ENACTMENT; AND PROVIDING FOR THE v EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on November 2, 1978, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the zoning atlas of the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the proposed changes and amendments to the zoning atlas were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and 'The Zoning Atlas of the City of Clearwater, Florida of 197811, as amended, is amended to indicate that fact as hereinafter set out; Zoned as RPD - Residential Planned Development With a Maximum Allowable Densit?y of 12 Units Per Acre Late 6 and 7, in the SE 1/4 of Section 12, Township 29 South, Range 15 East, according to the plat of "A portion of Pinellas Groves, Inc. property, 11 etc. recorded in Plat Book 3, page 15 of the Public Records of Pinellas County, Florida, Less road right-of-way. Section 2. All ordinances or parts of ordinances in conflict herewith _, - are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance b'e declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. d: 1863. Any person, or persona, firm or corporation or association of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the sum of Five Hundred Dollars ($540.00), or imprisonment in Jail for not exceeding sixty (60) clays or by both such fine and imprisonment in thesdiscretion of the Judge. Each day that a violation is permitted to exist shall constitute a separate offense. Section S. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabve set out. Section 7. The provisions- of this ordinance shall take effect immediately upon its passage.
