AN ORDINANCE AMENDING CHAPTER 22, TRAFFIC, OF
THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962 TO PROVIDE MINIMUM SPEED LIMITS
WITHIN THE CITY OF CLEARWATER AND FOR CHANGES IN
SUCH SPEED; TO PROVIDE FOR THE AUTHORITY OF THE
POLICE DEPARTMENT IN DIRECTING VEHICULAR TRAFFIC;
TO PROVIDE FOR THE REGULATIONS OF HITCHHIKING;
TO MAKE EXISTING SECTIONS CONFORM WITH THE REQUIRE-
MENTS CONTAINED IN CHAPTER 316 OF THE FLORIDA
STATUTES; AND TO PROVIDE REGULATIONS GOVERNING
THE OPERATORS OF BICYCLES; PROVIDING FOR REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, a review of present Chapter 22, Traffic, of the Code
of Ordinances of the City of Clearwater, demonstrates that revision is
needed in order to make such Chapter consistent with the provisions of
Chapter 316, Florida Statutes; and
WHEREAS, a need exists to provide standards such as will
govern the operations of bicycles;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 22,41 Speed Limits; Complaint and Summons,
of Article II, Operation of Vehicles, of Chapter 22, Traffic, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed
in its entirety and a new Section 22..41 is hereby enacted to read as follows:
Section 22-41. Speed Limits; Complaint and Summons.
(a) The speed limit at which vehicles can be driven upon the
streets of the City shall be thirty (30) miles per hour,
except in the following circumstances:
(1) School zones.
(2) Where posted signs state otherwise.
(b) No person shall operate a motor vehicle within the City at
a speed greater than is reasonable and-prudent under the
impending conditions and having regard to the actual
potential hazards then existing, and no person shall drive
any vehicle in a manner that would endanger the life or
property of any person.

(c) The fact the speed of a vehicle is lower than the foregoing
prima facie limit shall not relieve the driver from the duty
to 'decrease speed when approaching and crossing an inter-
section, when approaching and going around a curve, when
approaching a hill crest, when travelling upon any narrow
or winding roadway, or when special hazard exists in
respect to pedestrians or other traffic or by reason of
weather or highway conditions, and speed shall be
decreased as may be necessary to avoid colliding
with any person, vehicle, or other conveyance on or
entering the street in compliance with legal requirements
and the duty of all persons to use due care.
(d) No person shall drive a motor vehicle on any street at such
a slow speed as to impede or block the normal and reasonable
forward movement of traffic, except when a reduced speed
shall' be necessary for safe operation of such vehicle or in
compliance with law.
(e) In every charge of violation of Paragraphs (b) and (c), the
complaint, and also the Summons and Notice to Appear,
shall specify the speed at which the Defendant is alleged
to have driven, as well as prima facie evidence applicable
within the district or location.
(f) The Traffic Engineer, with the approval of the City Manager,
is authorized to modify the foregoing speed limits when in
his judgment such speed limit should be increased or reduced
without harm to the public, and in such cases appropriate
speed limit signs shall be erected in order to give notice
thereof.
Section 2. That Sections ZZ-3, 22-6 and ZZ-23 of Article I, In
General, of Chapter Z2, Traffic, of the Code of ordinances of the City of
Clearwater, Florida, 1962, be and the same are hereby amended to read
as follows:
Section ZZ-3. Police and Traffic Engineer Authority- --T-& lm'v-e_

The police department, under direction of the City Manager,
shall have full power and be charged with all duties in relation
to the mana'gerne!rkt direction of vehicular traffic and enforcement
of all laws governing vehicular traffic.
The traffic engineering department, under the direction of the
City Manager, shall have full power and be charged with all
duties in relation to the planning, engineering, and manazemer
of vehicular and pedestrian traffic.
Section 22-6. Police and Traffic En ineer Authority--Detouring Traffic.
Whenever the police department and/or traffic engineer by
and with the advice of the City Manager shall deem it
advisable for the public safety or convenience, to close
temporarily any street or part of street to vehicular
traffic or to vehicles of certain description, or to divert
the traffic thereon, or to diver t or direct the course of
pedestrian travel, such departments shall have power•and
authority to do so.

It shall be unlawful for any person to drive a motor vehicle
upon the streets of the City unless the same be provided
with a bell, horn, or similar alarm in accordance with
section .317r62 316. 271, Florida Statutes.
Section 22-75. Driver's license required.
It shall be unlawful for any person to drive or operate
a motor vehicle in the City unless such person has a
valid license as an operator or chauffeur under the
provisions of Florida Statutes, section ZZZr81 322. 03,
and related sections.
Section 4. That Section 22-10 of Article I, In General, of Chapter
22, Traffic, of the Code of Ordinances of the City of Clearwater, Florida,
1962, is hereby repealed in its entirety and a new Section 22. 10 and a new
Section 22-10. 1 are hereby enacted to read as follows:
Section ZZ-10. Bicycle Regulations.
(1) Every person riding upon a roadway shall be granted
all of the rights and be subject to all of the duties applicable
to the driver of a vehicle by this ordinance, or by Florida
Statute, Chapter 316. 111, except as Special Regulations
in this ordinance, or in Florida Statute, Chapter 316. 666,
which by their nature have no application.
(2) A person propelling a bicycle shall not ride other than
upon or astride a permanent and regular seat attached thereto.
(3) No bicycle shall be used to carry more persons at one
time than the number for which it is designed and equipped.
(4) Every person operating a bicycle upon a roadway shall
ride -with the flow of traffic as near to the right side of the
roadway as practical,' exercising due care when passing a
standing vehicle or one proceeding in the same direction.

(9) Any person operating a bicycle shall keep at least one
hand upon the handle bars.
(10) No parent of any minor child and no guardian of any minor
ward shall authorize or knowingly permit any such minor
child or ward to violate any of the provisions of this section.
(11) This section shall not apply upon any street while set
aside as a play street authorized herein or designated by
the State of ,Florida, Pinellas County or City of Clearwater.
Section 22-10. 1 Penalties for Violations of Bicycle Regulations.
Any person not a juvenile, as such such is defined by the laws of
the State, found guilty of a violation of any provisions found in
this section shall be punished by a fine of not more than $25. 00
and/or by impounding of such person's bicycle for a period not
to exceed ninety (90) days. Upon the recommendation of a Fudge
of a juvenile court or a completent court having jurisdiction over
the person of a minor, the State, County, or municipal authority
may impound such minor's bicycle for such period as the Court
may determine.
Section 5. That present Section 22-4, Section 22-7, Section 22-73,
Section 22-92, Section 22-104 and Section 22-110 be and the same are hereby
repealed in their entirety.
Section 6. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 7. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
