WHEREAS, the City Commission of the City of Clearwater, Florida, y »

received a sworn petition from Edward J. Yarrington and Helen
Yarrington, his wife, requesting the City to annex a certain parcel
of real estate described hereinafter, owned by them, into they
corporate limits of the City of Clearwater, Florida; andy
WHEREAS, the City Commission, after due consideration of said :i
request for annexation, at a regular meeting held on August 2, 1984, G?

voted unanimously to accept said request and authorized the proper

officials to set up a public hearing thereon for the determination :11 RII ai

and establishing of fire district classification and to prepare
an ordinance to annex said parcel of real estate into the corporate
limits of the City of Clearwater in accordance with the provisions
of Chapter 171, Florida Statutes; and
WHEREAS, on September 20, 1984, the City Commission of the
City of Clearwater, after proper public notice, held a public
hearing for the determination and establishment of fire' district
classification for said real property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be"'reviewed by the Local Planning Agency (LPA) for conformance
with plans adopted pursuant to the LGCPA; and
'WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required referral
process; and'

WHEREAS, this ordinance has been referred to and considered
by the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA.:
Section 1. After its evaluation of all evidence presented
at a proper public hearing, the City of Clearwater, acting by and
through its City Commission, by the authority and under the pro-
visions of Section 171.044, Florida Statutes, hereby annexes into
the corporate limits of the City of Clearwater, Florida, and redefines
the boundary lines of said City so as to include the following
described real property in Pinellas County, Florida, and establishes
fire district classification therefor:
A tract of land lying within Section 21, Township
28 South, Range 16 East, Pinellas County, Florida,
and being more particularly described as follows:
Commence at the NW corner of said Section 21; thence
S 00°04'24" W, along the West line of said NW 1/4
for 600.40 feet to a point on the North line of the
South.66 feet of the South 1/2 of the North 1/2 of
the NW 1/4 of the NW 1/4 of said Section 21; thence
S 89°35'08" E, along said North line, for 838.21 feet
to the P.O.B.; thence continue along said north line,
S 89°35'08" E, for 450.02 feet; thence S 00°03'27" E,
along a line 50 feet West of and parallel to the East
line of the NW 1/4 of the NW 1/4 of said Section 21,
for 399.74 feet; thence N 89°33'43" W, along the South
line of the North 1/2 of the South 1/2 of the NW 1/4
of the NW 1/4 of said Section 21, for 450.02 feet;
thence N 00°03'27" W, along a line 500 feet West of
and parallel to said East line for 399.55 feet to
the P.O.B., less the East 50 feet for right-of-way purposes.
The above described property is hereby designated
Fire District No. 2.
Section 2. The City of Clearwater does hereby certify that
the measures contained in this ordinance are consistent and in
conformance with the City's Comprehensive Plan and individual
elements thereof adopted pursuant to the LGCPA and directs that
same be.forwarded to the LPA for their receipt and appropriate
action.
Section,3. The City Commission hereby formally and according
to•law, accepts the dedication of all easements, streets, parks,
plazas, places, rights-of-way and other dedications to the public
which have heretofore been made by plat, deed or user within the
areas so annexed.

Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the
official maps and records of the City of Clearwater the foregoing
property and the fire district classification therefor.
Section 5. This ordinance and notice of the proposed
enactment of same has been properly advertised in a newspaper
of general circulation in accordance with Section 166.041,
Florida Statutes, and Section 171.044, Florida Statutes.
Section 6. This ordinance shall become effective immediately
upon its passage and enrollment in the City of Clearwater Ordinance
Book and a copy thereof being filed by the City Clerk for recording
in the office of the Clerk of the Circuit Court of Pinellas County,
Florida. In accordance with Section 171.091, and Section 171.044,
Florida'Statutes, a certified copy shall be filed with the
Department of State of the State of Florida.

' COMMISSION OF THE CITY OF CLEARWATER, FLORIDA.:-

Section 1. After its evaluation of all evidence presented
at a proper public hearing, the City of Clearwater, acting by and
>t through its City Commission: by the authority and under the pro-
visions of Section 171.044, Florida Statutes, hereby annexes into

the corporate limits of the City of Clearwater, Florida, and redefines
the boundary lines of said City so as to include the following ,
described real property in Pinellas County, Florida, and establishes
! fire district classification therefor:
F } A tract of land lying within Section 21, Township
28 South, Range 16 East, Pinellas County, Florida,
and being more particularly described as follows:
a Commence at the NW corner of said Section 21; thence

.A S 00°04'24" ff,•along the West line of said NW 1/4
for 60,0.40 feet to a point on the North line o,: the
` South 66 feet of the South 1/2 of the North 1/2 of
the NW 1/4 of the NW 1/4 of said Section 21; thence
S 89°35'03" E, along said North line, for 838.21 feet
to the P.O.B.; thence continue along said north line,
S 89°35'08" E, for 450.02 feet; thence S 00°03'27" E,
along a line 50 feet West of and parallel to the East
line of the NW 1/4 of the NW 1/4 of said Section 21,
for 399.74 feet; thence N 89°33'43" W, along the South
line of the North 1/2 of the South 1/2 of the NW 1/4
of the NW 1/4 of said Section 21, for 450.02 feet;
thence N 00°03'27"•W, along a line 500 feeC West of
and parallel to said East line for 399.55 feet to
the P.O.B. , less the East 50 feet for right-of--way purposes. '
The above described property is hereby designated

Section 2. The City of Clearwater does hereby certify that

conformance with the City's Comprehensive Plan and individual
elements thereof adopted pursuant to the LGCPA and directs that

Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the
official maps and records of the City of Clearwater the foregoing
property And the fire district classification therefor.

enactment: c'f same has been-properly advertised in a newspaper
of general•.circulation in accordance with Section 166.041, _
Florida Statutes, and Section 171.044, Florida Statutes.
Section 6. This ordinance shall become effective immediately
upon,its passage and enrollment in the City of Clearwater Ordinance
Book and a copy thereof being filed by the City Clerk for recording
in the office of the Clerk of the Circuit Court of Pinellas County,
Florida. In accordance with Section 171.091, and Section 171..044,
