ORDINANCE NO. 3778-84 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1984, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY k OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on September 20, 1984, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifi- cations for certain property annexed into the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and ' WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be'reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to LGCPA; and 'WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA; Section 1. The following described property in Clearwater, Florida, is,hereby classified and zoned as hereinafter indicated, and'."The Zoning Atlas of the City of Clearwater, Florida of 1984", as amended, is amended to indicate that fact as hereinafter set - .out; SF_E? ORDN I (J/ANCE O»d,.3778-84 12/6/84 A i •r' i 0 Zoned RS--100 - Sinqle Family Residence District A "tract of land lying within Section2l, Township 28 South, Range 16 East, Pinellas County, Florida, and being more particularly described as follows: Commence at the NW corner of said Section 21; thence S 00°04'24" W, along the West line of said NW 1/4 for 600.40 feet to a point on the North line of the South 66 feet of the South 1/2 of the North 1/2 of the NW 1/4 of the NW 1/4 of said Section 21 for the P.O.B.; thence S 89°35'08" E, along said North line, for 838.21 feet; thence S 00°03'27" E, along a line 500 feet West of and parallel to the East line of the NW 1/4 of the NW 1/4 of said Section 21, for 399.55 feet; thence N 89°33'43" W, along the South line of the North 1/2 of the South 1/2 of the NW 1/4 of the NW 1/4 of said Section 21, for 839.13 feet; thence N 00°04'24" E, along the West line of the NW 1/4 of said Section 21, for 399.20 feet to the P.O.B. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in con-•' formance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or .any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendment as hereinabove set out. Section 7.
