HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES

`r PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO-
VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, because of the 9th District Court of Appeal's
decision in City of Pompano Beach v. Richard Maynard Capalbo,
9 FLW 1716 (1984), the below section needs to be amended to
conform to the changes suggested by the decision;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 150.13, Sleeping in motor vehicles
prohibited, of Chapter 150, In General, of Title XII, Offenses,
of the Code of Ordinances, City of Clearwater, be and the same
is hereby amended to read as follows:
Sec. 150.13. Sleeping Lodging in or about motor
vehicles prohibited.
It shall be unlawful for any person to lodge er
sleep in, on or about any automobile, truck, trailer,
camping eamper or recreational vehicle or similar
vehicle in any public street, public park area, public ,
way, right-of-way, parking lot or other public property
within the limits of the city.
Section 2. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole or
any part thereof other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 5. The provisions of this ordinance shall take effect
immediately upon its passage.
