3760-84 E ORDINANCE NO. 3760-84 1?7?:, g?,S AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, REPEALING ORDINANCE NO. 3392-84 IN ITS ENTIRETY, RELATING TO UNDERGROUND PETROLEUM TANKS AS STATE STATUTES NOW PREVAIL; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Florida State Legislature has enacted legislation which preempts the City of Clearwater from enforcing any ordinance which is more restrictive relating to storage tank regulations; and WHEREAS, the-city commission of the City of Clearwater on February 2, 1984, enacted certain regulations as to underground petroleum tanks, by Ordinance No. 3392-84; and WHEREAS, Ordinance No. 3392--84 must now be repealed in order to comply with the new Stale statutes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Ordinance No. 3392-84 which was passed and adopted by the City Commission of the City of Clearwater, Florida, on February 2, 1984, is hereby repealed in its entirety. Section 2. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 3. The provisions of this ordinance shall take effect immediately upon its passage.
