ORDINANCE NO. 3742--84 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ARTICLE III, SPECIAL EVENTS, OF CHAPTER 116, PARKS, RECREATION AND BEACHES, OF TITLE IX, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, TO INCLUDE PARADES IN THE DEFINITION FOR SPECIAL EVENTS; TO SET FORTH THE INFORMATION WHICH SHALL BE INCLUDED IN THE APPLICATION FOR SUCH SPECIAL EVENTS; TO SET FORTH ALL PERMIT CONDITIONS; TO PROVIDE FOR REVOCATION OF SUCH PERMIT; TO REPEAL IN ITS ENTIRETY CHAPTER 125, PARADE PERMIT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. That Section 116.31, Definition, of Article III, Special Events, of Chapter 116, Parks, Recreation and Beaches, of Title IX, Streets, Sidewalks and Other Public Places, of the Code of Ordinances, City of Clearwater, oe and the same is hereby amended to read as follows: Sec. 116.31. Definition. "Special event" shall mean any meeting, activity, parade, gathering, or group of persons, animals, or vehicles, or a combination thereof, having a common purpose, design or goal, upon any public street, side- walk, alley, park, beach or other public place or building which special event substantially inhibits the usual flow of pedestrian or vehicular travel or which occupies any public area or building which results in preemptive use by general public or which deviates from the established use. The term special event shall not Ee construed to include a-parade-er a block party. The term "block party" shall mean a gathering comprised sub- stantially of neighbors in a residential area which requires the closing of a local street for the purpose of having a partyi_or other social recreational or an other type of assembla e. Section 2. A person seeking issuance of a special event permit shall file an application with the city manager or his authorized designee on forms provided by the city. An application for a special event permit shall be filed with the city manager or his authorized designee not less than ten4+0} fifteen.(15) days nor more than ninety (90) days before the date..on which it is proposed to conduct the special event. As used herein, financial disability_ shall mean lack of oresent?funds with which to nav the premium associated ante described herein. Section 3. That Section 116.36, Permit conditions, of Article 111, Special Events, of Chapter 116, Parks, Recreation and Beaches, of Title IX, Streets, Sidewalks and Other Public Places, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 116.36. Permit conditions. Permits issued under this article shall be subject to the following conditions: (1) A permit may be revoked upon discovery of the city manager or his authorized designee that any of the conditions•set forth in section 116.35 exist. (2) Special events may only be approved for daylight 'hours except in areas possessing appropriate artificial lights. (3) No special event shall be approved far Clearwater's beach areas on a holiday weekend. (4) The chief of police may stop a special event where a breach of the peace is occcirring or an activity in the nature of a riot has occurred. SR+ (6) The city manager or his authorized designee shall have authority to restrict, limit or prohibit the use or construction of platforms, chairs, or other equipment if he finds that their use would result in damage to city property or'constitute a hazard to safety or would block orinfringe upon some other .lawful use of the public property. (7) The grant of the permit shall not entitle the applicant to violate any other general park rules or regulations, or regulations applicable to the use of public property adopted by ordinance. (8) A deposit may be required where request is made to use city services or equipment. (9) In the case of parades, the applicant agrees that there will be no tossing of candy, medallions, or other E (10) The conduct of the event will not substantially . i.nterru t the safe and orderly movement of other traffic contiguous to its route. (11) The conduct of the event will not require the divers of so, great- a number- of _po_lice_officers of the city to pronerly police the line of movement and the area to the city, (12) The conduct of the event will not require the diversion of so great a number of ambulances and fire rescue units as to prevent normal ambulance and rescue service to portions of the city other than that to be occupied by the proposed line of march and areas continuous thereto. (13) at assembly points of the event will not unduly interfere with proper fire and police protection or ambulance service to, areas contiguous to the assembly areas. (14) The conduct of the event will not interfere with the movement of fire-fighting equipment en route to a fire. (15) The conduct of the event is not reasonably likely,- to cause injury to 2ersons or ra ert to rovoke dis- orderly conduct or create a disturbance. (16) The event is scheduled to move from its point _of origin to the Point of termination ex edit"iousl and without unreasonable delays en route. (17) Reimbursement to the city for expenses and fees, charged for a`prior?such event or parade-. Section 4. That Article 111, Special Events, of Chapter 116, Parks, Recreation and Beaches, of Title IX, Streets, Sidewalks and Other Public Places, of the Code of Ordinances, City of Clearwater, is hereby amended to enact a new Section 116.39 to read as follows: -4- ord. 37 '4X=Py 12/6/84 ,tR Sec. 116.39. Revocation. The city manager or his designee shall have the a authority to revoke a special event ermit issued pursuant to this article upon violation-,of-the---standarda for issuancerescribed in this article. Durin the event the chief of police or his designee shall have the authority to order a ceasing of the event should the continuance of such event contribute to public disorder or endanger life or property,. or find that the application was fraudulent in any manner, r f. .,. t1 c. ..... Section 5. That Chapter 125, Parade Permit, of Title X, Traffic and Motor Vehicles, of the Code of Ordinances, City of Clearwater, is hereby repealed in its entirety. Section 6. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 7. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 8. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 9. The provisions of this ordinance shall take effect immediately upon its passage.
