AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A PORTION OF A DRAINAGE AND UTILITY
EASEMENT IN OAK FOREST OF COUNTRYSIDE, PINELLAS
COUNTY, FLORIDA; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, it has been requested by John W. Kirtley 11, owner of
certain real property in Oak Forest of Countryside, in the City of
Clearwater, Florida, that the City of Clearwater, Florida, vacate
a certain portion of a drainage and utility easement;
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of easement is not
necessary nor required for municipal use and it is deemed to be to
the best interest and advantage of the City and the general public
that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The East 2.00 feet of the West 5.00 feet of
an existing 5 foot drainage and utility easement
less the North 10 feet thereof, lying in Lot 17,
Oak Forest of Countryside, according to the map
or plat thereof as recorded in Plat Book 70, pages
20 and 21, of the Public Records of Pinellas County,
Florida,
be and the same is hereby vacated, closed and released, and the
City of Clearwater hereby quit claims and releases all of its right,
title and interest thereto to the persons, firms or corporations
entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in-accordance with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon,its passage.
