ORDINANCE NO. 3727-84
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER,FLORIDA, 1984, AS AMEWDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OV'ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on August 2, 1984, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the zoning atlas of the City of Clear-
water in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evalua-
tion of all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Acte
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local. Planning AGency (LPA) for conformance with
plans adopted pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to each required
referral process; and
WHEREAS, this Ordinance has been referred to and considered
by the PCPC.under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and "The Zoning Atlas of the 6ity of Clearwater, Florida of 1984",
as amended, is amended to indicate that fact as hereinafter set
out:

A tract of land lying within Section 32, Township 28
South, Range 16 East, Pinellas County, Florida, being
more particularly decribed as follows:
Commence at the NW corner of the SW 1/4 of said Section
32; thence S 00°00'58" W, along the West line of the
SW 1/4 of said Section 32, said West line also being
the centerline of U.S. Highway 19, for 1508.60 feet;
thence leaving said West line S 89°34'50" E, for
100,.00 feet to a point on the easterly right-of-way
line of U.S. Highway 19, said point also being a
point on the northerly right-of-way line of the
Florida Power Corporatbn right-of-way, as recorded
in Deed Book 1516, page 581 of the Public Records
of Pinellas County, Florida; thence S 89°57'0711 E,
along said northerly right-of-way line, for 314.32
feet to the P.O.B.; thence N 04°12'51" E, for 39.75
feet; thence N 43°13'25" E, for 55.39 feet; thence
N 50°49'16" E, for 103.23 feet; thence N 39°08'12" E,
for 100.07 feet to a point on the West right--of-way
line of Main Street; thence along said West right-
of-way line, S 00°01'50" E, for 222.99 feet to the
point of intersection with the northerly right-of-
way line of said Florida Power Corporation right-
of-way; thence N 89°57'07" W, along said right-of-
way line, for 184.16 feet to the P.O.B.
Section 2. The City of Clearwater does hereby certify that
the measures contained in this ordinance are consisent and in con-
formance with the City's Comprehensive Plan and individual elements
thereof adopted pursuant to the LGCPA and directs that same be
forwarded to the LPA for their receipt and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole,
or any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and
set out and show upon the official zoninq atlas of the City of
C."Learwater.the.foregoing-.amendment as hereinabove set out.
