AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A CERTAIN RIGHT-OF-WAY EASEMENT IN SECTION
8, TOWNSHIP 29 SOUTH, RANGE 16 EAST,, PINELLAS
COUNTY, FLORIDA; PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, it has been requested by V. Jack Kennedy, owner of
certain real property in Section 8, Township 29 South, Range 16
East, in the City of Clearwater, Florida, that the City of
Clearwater, Florida, vacate a certain right-of-way easement;
and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said easement is not necessary nor
required for municipal use and it is deemed to be to the best
interest and advantage of the City and the general public that the
same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The right-of-way easement recorded in O.R.
4028, pages 18 and 19, of the Public Records
of Pinellas County, Florida, LESS that portion
lying within the West 150 feet of the SW 1/4
of Section 8, Township 29 South, Range 16 East,
and LESS that portion lying within the South
100 feet of the SW 1/4 of said Section 8,
be and the same is hereby vacated, closed and released, and the
City of Clearwater hereby quit claims and releases all of its right,
title and interest thereto to the persons, firms or corporations
entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon its passage.
