ORDINANCE NO. 3703-84
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1984, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
-OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on July 19, 1984, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for
the determination and establishment of zoning classifications for
certain property annexed into the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing.zoning for such newly annexed real property were
approved by the City Commission after its evaluation of all evidence
presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required referral
process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and "The Zoning Atlas of the City of Clearwater, Florida of
-198411, as amended, is amended to indicate that fact as hereinafter
set out:

Zoned RM-12•- Duplex-Apartment Residential_ District
A parcel of land lying in the SW 1/4 of the NE 1/4
of Section 17, Township 29 South, Range 16 East,
Pinellas County, Florida, described as follows:
Commencing at the NE corner of Gulf to Bay Gardens
as recorded in Plat Book 50, page 60 of the Public
Records of Pinellas County, Florida; run thence
S 89°57'24" E, along the Easterly projection of
the North boundary of said Gulf to Bay Gardens a
distance of 200.00 feet to a P.O.B.; continue thence
S 89°57'24" E, 100.00 feet; thence S 00°20'15" E,
parallel to the East boundary of said Gulf to Bay
Gardens, 300.00 feet; thence N 89°57'24" W, 100.00
feet; thence N 00°20'15" W, parallel to said East
boundary of Gulf to Bay Gardens, 300.00 feet to the
P.O.B.
Section 2. The City of Clearwater does hereby certify that
the measures contained in this ordinance are consistent and in
conformance with the City's Comprehensive Plan and individual
elements thereof adopted pursuant to the LGCPA and directs that
same be forwarded to the LPA for their receipt and appropriate
action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.

Section 4. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole,
or any part thereof other than the part declared to be invalid.
Section 5. Notice'of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and
set out and show upon the official zoning atlas of the City of
Clearwater the foregoing amendment as hereinabove set out.
Section 7. Section 1 of this Ordinance shall not become
effective until the requisite authorization has been received
from the Pinellas.County Board of County Commissioners pursuant to
its powers under Chapter 171.062 (2), Florida Statutes, and filed
with the City Clerk.
