Authority; short title. (a) Pursuant to the authority granted by Article VIII, Section 2 (b), Florida Constitution, as implemented by the legislature under F.S. §166.021, known as the "Municipal Home Rule Powers Act", the city commission hereby establishes a-preeeduEe-whereby a board of designated city of_fi.cials_appointed by the city-manager to oversee the procedures whereby property, including parkways, located in the incorporated area of the city may be cleared of excessive growth of weeds or other plants or cleared of excessive accumulation of plant material or of debris, trash, junk, other noxious materials and abandoned property. (b) This chapter shall be known as the "City of Clearwater Lot Clearing Ordinance." Section 2. That Section 95,03, Definitions, of Chapter 95, Lot Clearing, of Title VIII, Public Health and Safety, of the Code of ordinances, city of Clearwatr, be and thb. same is hereby amended to.read as follows: Sec. 95.03. Definitions. R*F:,?'f?..??? ? ?1 Debris shall mean material which is stored externally and ie-net.-etherwise-eevered-and shall include, but not be limited to the following: Discarded household items, inoperative or discarded machinery, automobiles er s appliances, refuse, garbage, rubbish, trash er L junk, used scrap er j discarded lumber, pipe steel, plumbing fixtures; insulation, and-ether-building-materialT-een- struetien-equipmentT-taRksT-easksT-eansT-eld-re€rigeratersT- barrels, boxes, drums, piping, glass, old iron, machinery, excelsior or plastic or like materials. Excessive growth shall mean the growth of weeds or plants which are not cultivated or landscaped or regularly tended which reach a height in excess of twelve (12) inches. Owner shall mean the person, corporation, partnership, company, trust, estate or any combination of other business or legal entities, singular or plural, which is a record owner or owners as recorded on the current tax rolls of the county. Property owned and operated as condominium the owner shall mean the condominium association and not the individual unit owners. Section 3. That subparagraphs (b)f_(c) and (d) of Section 95.04, Prohibitions; removal of abandoned property, of Chapter 95, Lot Clearing, of Title VIII, Public Health and Safety, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 95.04. Prohibitions; removal of abandoned property. (b) Ale-person--shall-permit-the-exeessive-grewtk-or aeeemulaties-e€-plant-material--er-the-aseumulatien of-debris-er-ether-similar-staterial-epexi--property situated-erg-street-right-of-way-in-the-ineerperated limits-99-the-eityv The tenant occupant and/or property owner of any•real property abutting any dedicated right-of-way in the city shall be required to keep such right-of-"way in a clean and sanitary condition at all times by keeping the same free from weeds and trash of all kinds and b keeping the rass mowed. In mowin the -grass in the area designated herein, the property owner shall cut the crass in such a manner that the grass as mowed does not extend over the curbline or edge of pavement of an improved right-of-waymore than four (4) inches. (c) Any owner or lessee of developed property who remove, or has removed from the property any hedges, tree trimmings, boxes or other household items, shall have the same cut in lengths no longer than four (4) feet .and deposited at the edge of the street in front of the property for regular pick up by city sanitation trucks of the city on their regular days of pick up. If the property owner or lessee contracts to have a commercial landscaper, tree surgeon or others in the business of_clearing or improving property, the contractor will be responsible for the removal of all debris and cuttings. Failure to remove the debris and cuttings will result in a'-.citabibni.bai.isdued to the violator. Any person violating the provisions of this sub pa_r_a_gzaphshall be subject to a fine of not more than One Hundred Dollars ($100.00). (d) Pursuant to F.S. 705.16 (4) (a), (b), the provisions of such section are hereby adopted by reference and shall constitute the provisions that will apply in the removal of abandoned property from public and private property, except rights-of-way, in the city. The term "abandoned property" shall have that meaning as set forth in F.S. §705.16 (2) (b). The term "debris" as defined in section 95.03 and the term "abandoned property" as defined herein shall be construed as being mutually exclusive, in utilizing the procedure set out in F.S. §705.16 (4) (a), (b), such required notice shall contain a provision providing that a pre-taking hearing will be conducted by-the-Sity Manager before the City of Clearwater Lot Clearing Board setting forth the place and time of such hearing within five (5) days of the removal time provided in the notice. Such provisions shall also advise the owner or person interested in the property proposed to be removed that such person may appear at such hearing and,contest the decisionthat such property is abandoned. The procedure incorporated by this subparagraph to be utilized in removing abandoned property shall be applied separately from the procedure otherwise set out in this chapter for the clearance of lots. The sanitation superintendent or his designee shall have the responsibility of enforcing the provisions of F.S. 5705.16. Section 4. That Section 95.06, Designation of investigating and enforcement authority; authority of sanitation division, of Chapter 95, Lot Clearing, of Title VIII, Public Health and Safety, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 95.06. Designation of investigating and enforcement authority; authority of sanitation division. The sanitation division of the utilities department is hereby designated as the investigating and enforcing authority pursuant to the provisions of this chapter. The sanitation division is hereby authorized and directed to receive all complaints of a violation of this chapter, make inspections to determine if a violation of this chapter exists, gather all relevant information concerning such complaints, conduct field investigations and inspections of real property, and to enter upon real property in the conduct of its official business pursuant to this chapter. Clearance of property. Upon authorization of the zt-?*n-i{m boards unless appealed to the city commission, that certain property found to be in violation of this chapter shall be cleared, the sanitation division shall reinspect such property in order to verify whether compliance with this chapter has been achieved. That Section 95.11, Establishment of lien, of Chapter 95, Lot Clearing, of Title VIII, Public Health and Safety, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 95.11. Establishment of lien. The city clerk upon notifcation from the lot clearing board and/or sanitation division of the costs associated with clearing the lots shall request the city commission to _adopt a resolution assessing such costs. The city commission is hereby authorized to assess against property which is cleared by the sanitation division or its agents pursuant to this chapter, the actual cost to the city of clearing the property. The city commission is further authorized to assess against the property found to be in violation of this chapter administrative costs, pursuant to the authority granted by section 95.09. Such actual cost of clearance plus such administrative costs shall con- stitute a lien against the property. A notice of lien in such form as the city commission shall determine may be filed in the office of the clerk of the circuit court, and recorded as other liens are recorded. The same, upon recording, shall be constructive notice of the existence of said lien which may be foreclosed by the city in the manner in which mortgages are foreclosed pursuant to general law in the circuit court. ' DRAFT LOT CLEARING BOARD CITY OF CLEARWATER, FLORIDA - RULES AND REGULATIONS ARTICLE I NAME ` • The name of this Board shall by the Lot Clearing Board of the City of Clearwater, Florida." ARTICLE II JURISDICTION The Board has jurisdiction over those matters which are set forth in Chapter 95, of the Code of Ordinances of the City of Clearwater, Florida ARTICLE III OFFICERS AND THEIR DUTIES/APPOINTMENT OF MEMBERS Section 1: The city manager will appoint three persons to the board. The composition of the board will be the Assistant Utilities Director, Assistant to the City Manager and the Assistant City Clerk. Section 2: The Assistant Utilities Director will be the Chairperson and the Assistant to the City Manager will be the Vice Chairperson. The Assistant City Clerk will provide or act as the Recording Secretary. Section 3: The Chairperson shall prredide at all meetings of the Board and shall have the duties normally qonferred by parlimentary usage of such officers. The Chairperson shall have the privilege of discussing all matters before the Board and shall have the same voting rights as all Board members. Section 4: The Assistant to the City Manger shall be the Vice Chairperson and shall act in the absence of the Chairperson. ARTICLE IV MEETINGS Section 1: Regular Meetings: Regular meetings shall be held twice monthly on the second and fourth Tuesday at 2:00 P.M. The Board may set meetings more frequently if necessary. Section 2i Special Meetings: Special meetings may be called by the Chairperson. Section 3: Notice: Notice of all meetings, both regular and special, shall be given to all Board members at least twenty-four (24) hours in advance of the meeting. Section 4: Attendance: Members shall notify the Chairperson.of the Board if they are not going to attend a meeting. Section 5: Quorum: A quorum of the Board shall consist of two (2) members, and an affirmative vote of a majority of those present shall be necessary to pass any motion or adopt any order unless otherwise specified herein. ARTICLE VI INITIATION OF ACTIONS BEFORE THE BOARD All actions before the Board shall be initiated by the Sanitation Division following a complete investigation of the properties in question/violation of Chapter 95, Lot Clearing. ARTICLE VII HEARINGS The following proceduresiwill be observed in hearings before the Board: a. Assuming proper notice of the hearing has been provided to the respondent as provided by Chapter 95, a hearing may proceed in the absence of the respondent. b. The City shall present its case and respondent shall present their case. Huth parties will have an opportunity to cross- examine all witnesses. c. The Board or.if it is required that an attorney for the City may question any witness as it feels necessary. d. The right of parties to present rebuttal evidence is discretionary with the Board. e. The Board may, in its discretion, adjourn a Hearing for a period not to exceed 31-days at any time during the Hearing, and request further information from either party. f. If a hearing is adjourned, at the time the Hearing is reconvened, only those Board members that have been present from the beginning of the Hearing may participate in the deliberations and decision making process. (This requirement may be waived by the consent of both parties. g. Upon completion of all the evidence, the Chairperson shall close the hearing. h. The Board may only consider that evidence which is presented at the Hearing before reaching their decision. i. The Board shall immediately deliberate in open session before the public. J. The Board shall orally issue an Order which is approved by a majority of the 3oard. The Order shall contain findings of fact and conclusions of law and stata the affimative relief granted by the Board.
