AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 52, WATER SYSTEMS, OF TITLE V,
UTILITIES, OF THE CODE OF ORDINANCES, CITY OF
CLEARWATER, TO ENACT A NEW ARTICLE III, WATER
SHORTAGE PLAN, TO PROVIDE FOR THE LOCAL ENFORCE-
MENT OF THE SOUTHWEST FLORIDA WATER MANAGEMENT
DISTRICT; PROVIDING DEFINITIIONS; PROVIDING FOR
APPLICATION OF THE PROVISIONS OF SAID ARTICLE;
PROVIDING FOR ENFORCEMENT AND PENALTIES; PROVIDING
THAT WATER USERS ACCEPT THESE PROVISIONS; PRO-
VIDING FOR PUBLIC NOTICE AND HEARINGS; PROVIDING
FOR RECISION OR MODIFICATION OF SUCH RESTRICTIONS;
PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, from time to time a water shortage may arise affecting
City of Clearwater water service area; and
WHEREAS, during such water shortage conditions, the amount of
surface and ground water supplies may become perilously low and
insufficient to meet current or anticipated demands; and
WHEREAS, upon the existence of such conditions, it becomes
imperative to the public well.-being that certain uses of water be
restricted or curtailed, and that available water resource be
allocated; and
WHEREAS, the Southwest,Florida Water Management District
(SWFWMD) has primary responsibility under Chapter 373, Florida
Statutes, for regulating water use and allocating available water
supplies during periods of water shortage; and
WHEREAS, a water shortage emergency may from time to time be
declared by the SWFWMD: and
WHEREAS, SWFWMD has adopted a "Water Shortage Plan" for the
purpose of allocating and conserving the water resources during
periods of water shortage, and maintaining a uniform approach
towards water use restrictions during such periods; and
WHEREAS, SWFWMD has requested the assistance of the City of
Clearwater to provide the SWFWMD with all possible assistance in
the enforcement of the provisions'of the "Water Shortage Plan"
during any possible water shortage or water shortage emergency
that may occur in the future; and

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 3. That Chapter 52, Water Systems, of Title V, Utilities,
of the Code of Ordinances; City of Clearwater, is hereby amended
to enact a new Article III, Water Shortage Plan, to read as

?..Y ARTICLE III. WATER SHORTAGE PLAN.
Sec. 52.43. Definitions.
For the purpose of this Article the following terms,

District.
(b) "Person" is an erson, firm, partnership, association,

(c) "Water resource" means an and all water on or beneath

,(d) "Water shortage condition" is when sufficient water is
not available to meet resent or anticipated needs of
ersons using the water resource or when conditions
are such as to require temporary reduction in total
water usage within a particular area to protect the
water resource from serious harm. A water shortage
usuallv occurs due to drought.

Sec. 52.44. Application of Article.
The provisions of this Article shall apply to all persons
using the water resource whether from public or rivatel
owned water utility systems, private wells or private
connections with surface water bodies. This Article shall
not apply to persons using treated effluent or saltwater.
Sec. 52.45. Declaration of Water Shortage; Water
Shortage Emergency.

Upon such declaration all water use restrictions or
!other measures ado fed b the District pursuant to
Chapter 40D-21,-Florida Administrative Code applicable
to Cit of rwater, or an portion thereof, shall be
sub ect to the enforcement action pursuant to Section
52.46 of this Article. An violation_of the provisions

order issued pursuant thereto shall be a violation

Sec. 52.46. Enforcement.

Sec. 52.47.• Penalties.
Violation of any provision of this Article shall be

Sec._.._52.48. Water users to Accept Provisions of
this Article.
No water service shall be furnished to an erson b a ubl
or rivate utility unless such person agrees to acce t all
the revisions of this Article. The acceptance of water
service shall be in itself the acceptance of the nrnvisinn.c
Sec: 52.49. Public Hearings and Notices Required.
The requirement for public hearin s and for notices
to affected governmental agencies and affected pro pert
owners shall be substantial) as provided for in the
current "Water Shortage Plan" of SWFWMD and as amended
from time to time.
Section 52.50. Recission.
When the overnin board and executive director of the
District determines that a water shorts a condition no '
longer exists or no longer exists to the same degree,
the District shall rescind or modify the restriction it
has adopted. notification to local governments and to
other persons affected b this Article shall be accordin
to the provisions of Section 52.49 hereof.

Section 2. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 5. The provisions of this ordinance shall take effect
immediately upon its passage.
