AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING CERTAIN RIGHT-OF-WAY IN CHAUTAUQUA SUB-
DIVISION, UNIT 4, SECTION A AND UNIT 5, SECTION A,
PINELLAS COUNTY, FLORIDA; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, it has been requested by Premier Properties, Incorporated,
owner of certain real property in Chautauqua Subdivision, Unit 4,
Section A and Unit 5, Section A, in the City of Clearwater, Florida,
that the City of Clearwater, Florida, vacate a certain right-of-
way; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said right--of--way is not necessary
nor required for municipal use and it is deemed to be to the best
interest and advantage of the City and the general public that the
same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
All of First Street East between Sixth Avenue
South to Tenth Avenue South as shown on the plat of
Chautauqua Subdivision Unit 4, Section A, as
recorded in Plat Book 9,' page 145, and Unit 5, Section
A, as recorded in Plat Book 18, page 61, of the Public
Records of Pinellas County, Florida,
be and the same is hereby vacated, closed and released, and the City
of Clearwater hereby quit claims and releases all of its right, title
and interest thereto:to-.the persons,-firms or corporations entitled
thereto by law, excepting that the City of Clearwater hereby retains
a drainage and utility easement the full width of the said described
real property for the installation and maintenance of any and all
public utilities.thereon.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
