ORDINANCE NO. 3587-84
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A CERTAIN UTILITY EASEMENT III BAY TERRACE
AND BAY TERRACE ADDITION SUBDIVISION, PINELLAS
COUNTY, FLORIDA; PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS,.it has been requested by Gordon E. Graham, owner of
certain real property in Bay Terrace and Bay Terrace Addition
Subdivision, in the City of Clearwater, Florida, that the City of
Clearwater, Florida, vacate a certain utility easement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said easement is not necessary nor
required for municipal use and it is deemed to be to the best interest
and advantage of the City and the general public that the same be
vacated:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The East 5 feet of Lot 15, less the South 5 feet
thereof, and the West 5 feet of Lot 16, less the
South 5 feet thereof, all in Block B, Hay Terrace
and Bay Terrace Addition Subdivision, according to
the map or plat thereof as recorded in Plat'Book 13,
page 22 of the Public Records of Pinellas County,
Florida,
be and the same is hereby vacated, closed and released, and the
City of Clearwater hereby quit claims and releases all of its right,
title and interest thereto to the persons, firms or corporations
entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in'accordance with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon its'-passage.
