ORDINANCE NO. 3585-84.
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1984, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on January 19, 1984, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing
for the determination and establishment of zoning classifications
for certain property annexed into the City of Clearwater in accordance
with procedure as established; and
WHEREAS,,certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were
approved by the City Commission after its evaluation of all evidence
presented at the-said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local. Planning Agency (LPA) for conformance with
plans adopted pursuant to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required
referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
..Section t. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and "The Zoning Atlas•of the City of Clearwater, Florida of 198411,
as "amended, is,amended to indicate that fact as hereinafter set

Zoned ISP - Institutional Semi-Public District
A parcel of land lying in the W 1/2 of the SW 1/4
of Section 36,, Township 28 South, Range 15 East,
Pinellas County, Florida, and being more particularly
described as follows:
Commence at the NE corner of the Sw 1/4 of said
Section 36; thence N 89°49'04" W along the North
lane of the SW 1/4 of said Section 36, for 1334.62
feet to the point of intersection of the East line of
the NW 1/4 of the SW 1/4 of said Section 36; thence
S 00°01'48" E, along said East line, for 50.00 feet
to a point on the West line of the Plat of Lake Pines
Estates Unit 2, as recorded in Plat Book 33, page 83
of the Public Records of Pinellas County, Florida, said
point also being the P.O.H.; thence continue S 00°01'48"
E, along said East line, for 988.89 feet to a point on
the West line of the Plat of Lake Pines Estates Unit 3,
as recorded in Plat Book 34, page 16 of the Public Records
of Pinellas County, Florida, also being a point of inter-
section of the North right--of-way line of Palm Drive
(A 60 foot right-of-way); thence N 89°41'22" W,
for 60.00 feet; thence N 02°00'00" W, 120.00 feet; thence
N 17°00'00" W, 120.00 feet;.thence N 78°00'00" W, 41.77
feet; thence N 00°01'48" W, for 745.64 feet; thence
S 89°49'04" E,,for 140.00 feet to the P.O.B.
Section 2. The City of Clearater does hereby certify that
the measures contained in this ordinance are consistent and in
.conformance with the City's Comrehensive Plan and individual elements
thereof adopted pursuant to the LGCPA and directs that same be
forwarded to the LPA for their receipt and appropriate action.
Section 3'. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
'Section 6.' The Planning Director is directed to include and
set out and show upon the official zoning atlas of the City of
Clearwater-the foregoing amendment as hereinabove set out.

-Section 7. Section 1 of this Ordinance shall not become
effective until the requisite authorization has been received from
the Pinellas County Planning Council pursuant to its powers of
Local Planning Agency review or Land Use Plan amendments, as is
applicable.
