ORDINANCE NO. 3584-84 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1984, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on January 19, 1984, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifications for certain property annexed into the City of Clearwater in accordance with procedure as.established; and 'WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS,.the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof. be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral 'process; and :.WHEREAS, this Ordinance has been referred to and considered by 'the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE C= OF CLEARWATER, FLORIDA: Section 1: The following described property in Clearwater, .,Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 1984", as amended, is amended to indicate that fact as hereinafter set out: ' 7-a.9-84 Zoned RPD - Residential Planned Development with a maximum of 7.6 units per acre A parcel of land lying in the W 1/2 of the SW 1/4 of Section 36, Township 28 South, Range 15 East, Pinellas County, Florida, and being more particularly described as follows: Commence at the NE corner of the SW 1/4 of said Section 36; thence N 89°49'04" W along the North line of the SW 1/4 of said Section 36, for 1334.62 feet to the point of intersection of the East line of the W 1/2 of the SW 1/4 of said Section 36; thence S 00°01'48" E along said East line for 1085.89 feet; thence N 89°41122" W, for 60.00 feet to the P.O.B.; thence S 00°01'48" E, for 48.68 feet to the point of curvature of a curve concave to the East; thence South- easterly along the arc of said curve having a radius of 400.00 feet, a central angle of 08°57'10", an arc length of 62.50 feet and a chord bearing S 04°30'23" E, for 62.44 feet to the Point of Tangency; thence S 08°58'58" E, for 98.01 feet to the point of curvature of a curve concave to the West; thence Southeasterly along the arc of said curve, having a radius of 400.00 feet, a'central angle of 08°57'10", an arc length of 62.50 feet and a chord bearing S•04°30'23" E for 62.44 feet to the point of tangency; thence S 00°01'48" E for 603.68 feet to a point on the North line of the S 1/2 of the SW 1/4 of the SW 1/4 Section 36, also being the North line of the Plat of Spring Lake Heights, Unit Two, as recorded in Plat Book 69,.page 80, of the Public Records of Pinellas County, Florida.; thence N 69°25'58" W, along said North line, for 305.01 feet; thence N 00°01'48" W, for 260.00 feet; thence N 66°04'03" W, for 49.24 feet; thence N 07°41'16" W, for 240.14 feet; thence N 45°43'26" E, for 107.49 feet; thence N 00°01'48" W, for 279.17 feet; thence S 89°41' 22" E, for 280.00 feet to the P.O.B. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements therecf adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City'of Clearwater the foregoing amendment as hereinbove set out. Section 7, Section 1 of this Ordinance shall not became effective until the requisite authorization has been received from the Pinellas County Planning Council pursuant to its powers of Local Planning'Agency review or Land Use Plan amendments, as is applicable.
