ORDINANCE NO. 3576-84
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
REPEALING SECTION 150.065, LOITERING IN CONNEC'T'ION
WITH UNLAWFUL USE, POSSESSION OF CONTROLLED SUB-
STANCES; INTOXICANTS, ETC., OF CHAPTER 150, IN
GENERAL, OF TITLE XII, OFFENSES, OF THE CODE OF
ORDINANCES, CITY OF CLEARWATER; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENAC'T'MENT; AND PRO-
VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the decision of Sawyer v. Sandstrom, 615 F. 2d 311
(1980) has drawn Section 150.065 in question; and
WHEREAS, by reason of such fact the better practice would be
to repeal such ordinance since other enforcement tools are available
in Chapter 893,. Florida Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 150.065, Loitering in connection
with unlawful use, possession of controlled substances; intoxicants,
etc., of Chapter'150, In General, of Title XII, Offenses, of the
Code of Ordinances, City of Clearwater, be and the same is hereby
repealed.
Section 2. Notice of the proposed enactment of this
ordinance has been properly advertised in a newspaper of general
circulation in accordance with Section 166.041, Florida Statutes.
Section 3. The provisions of this ordinance shall take effect
