ORDINANCE NO. 3570-84
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A CERTAIN PORTION OF RIGHT-OF--WAY IN
GRAND VIEW TERRACE SUBDIVISION, PINELLAS COUNTY,
FLORIDA; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, it has been requested by Thomas J. O'Brien, owner,
of certain real property in Grand View Terrace Subdivision, in
the City of Clearwater, Florida, that the city of Clearwater,
Florida, vacate a certain portion of right-of--way; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of right-of-way is not
necessary nor required for municipal use and it is deemed to be to
the best interest and advantage of the City and the general public
that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following,:
From the NE corner of Lot 45, Grand View Terrace,
according to the.snap or plat thereof as recorded
in Plat Book 12, page 3 of the Public Records of
Pinellas County, Florida, said corner being the
P.O.B., proceed North along the alignment of the
East property line of Lot 45, 11.50 feet; thence
West;. 90°00'00° to said line, 63.31 feet to a point
on a curve, said curve being the Southerly right-
of-way of Lake Avenue West; from said point on a
curve proceed Easterly along said curve to the P.O.B.;
said curve having a radius of 180.0 feet, a chord of
64.35 feet, an arc of 64.69 feet, and a delta of
20°35'36",
be and the same is hereby vacated, closed and released, and the
City of Clearwater hereby quit claims and releases all of its right,
title and interest thereto to,the persons, firms or corporations
entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record.
this ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
