ORDINANCE NO. 3552-84 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1984, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVID11r FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on March 15, 1984, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifications for.certain property annexed into the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this ordinance has been referred to and considered by the PCPC under said process; NOW,,THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and""The Zoning Atlas of the City of Clearwater, Florida of 1984", as amended, is amended to indicate that fact as hereinafter set out: . . Ord.-3552=84 6-7-84 S4 Zoned CG - General Business District I That part of Lot 8, in SW 1/4 of Section 1, Township 29 South, Range 15 East, as shown by plat of.Pinellas Groves, Inc., recorded in Plat Book 3, Page 15, Public Records of Pinellas County, Florida, lying within the Following described tract: Begin at the NW corner of the SW 1/4 of said Section 1, and run S 00°08'02" E along the West line of said Section 1, 50.00 feet to a point on the South right- of-way line of Sunset Point Road (C.R. :'588); thence S 89°06'54" E along said right-of-way line, 30.00 feet to the P.O.B.; thence continue S 89°06'54" E along said right-of-way line, 150.00 feet; thence S 00°08'02" E parallel to the West line of said Section 1, 150.00 feet; thence N 89°06'54" W, parallel to the South right-of-way line of Sunset Point Road (C.R. 75BB), 150.00 feet; thence N 00°08'02" W along a line parallel to the West line of said Section 1, 150.00 feet to the P.O.B., together with abutting right-of-way for Keene Road. Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conform- ance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4: Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not-affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper.of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show. upon the official zoning atlas of the City of Clearater the foregoing amendment as hereinabove set out. .,.Section 7.
