3501-84 ORDINANCL NO. 3501-84 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING CHAPTER 150, IN GENERAL, OF TITLE XII, OFFENSES, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, BY-AMENDING SECTION 150.14, DISORDERLY CONDUCT, TO PROHIBIT LOITERING AND TO PROVIDE A DEFINITION THEREFOR; PROVIDING FOR THE REPEAT, OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 150.14, Disorderly conduct, of Chapter 150,.In General, of Title XII, Offenses, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 150.14. Disorderly conduct and loitering. (a) It shall be unlawful for any person acting either alone or.in concert with one or more persons to: (1) Act in a violent or tumultuous manner toward another whereby any person is placed in fear of safety of life and limb; (2) Engage in conduct whereby the property of another is placed in danger of being destroyed or damaged; (3) Use fighting words directed toward another in any public place (fighting words shall mean words which by their very utterance inflict injury, to tend to incite an immediate breach of the peace); (4) Violently interfere with another person's pursuit of a lawful occupation; (5) Halt or attempt to halt or endeavor by provocative acts to halt the flow of vehicular or pedestrian traffic upon any public street, highway, sidewalk or way, or congregate with one or more persons in such a manner as to halt or impede the flow of vehicular or pedestrian traffic upon any public street, highway, sidewalks or way and refuse to clear the way upon lawful order; or Engage in, or solicit another to engage in lewd, lascivious, or dissolute conduct in any public place.or in any place open to the public or exposed to public view. 5-3-84 (b) Loitering. Al]. ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance be declared by "a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordin.lnce as a whole, or any part.thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Sectin 166.041, Florida Statutes. Section 5.
