AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING LOT 10, JOHN'S PARKWAY SUBDIVISION,
PINELLAS COUNTY, FLORIDA, INTO THE CORPORATE
LIMITS OF THE CITY OF CLEARWATER, FLORIDA, AND
REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITION ACCORDING TO THE PROVISIONS
OF THE CHARTER OF THE CITY OF CLEARWATER, FLORIDA,
AND THE LAWS OF FLORIDA; AFTER PROPER PUBLIC NOTICE
AND PUBLIC HEARING THEREON, ESTABLISHING THE FIRE
DISTRICT CLASSIFICATION FOR SAID PROPERTY; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO-
VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Daniel R. Newcombe and Violet A.
Newcombe, his wife, requesting the City to annex a certain parcel
of real estate described hereinafter, owned by them, into the
corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission,atter due consideration of said
request for annexation, at a regular meeting held on January 5,
1984, voted unanimously to accept said request and authorized the
proper officials to set up a public hearing thereon for the deter-
mination and establishing of fire district classification and to
prepare an ordinance to annex said parcel of real estate into the
corporate limits of the City of Clearwater in accordance with the
-provisions of Chapter 171, Florida Statutes; and
WHEREAS, on February 2, 1984, the City Commission of the City
of-Clearwater, after proper public notice, held a public hearing
far the determination and establishment of fire district classifi-
cation for said real property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
`be.revie'wed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to the LGCPA; and
" WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the.
'.PCPC-has.adopted guidelines with reference to such required referral
process; and
WHEREAS,.this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at
a proper public hearing, the City of Clearwater, acting by and through
its City Commission, by the authority and under the provisions of
Section 171.044, Florida Statutes, hereby annexes into the corporate
limits of the City of Clear-water. Florida, and redefines the boundary
lines of said city so as to include the following described real
property in Pinellas County, Florida, and establishes fire district
classification therefor:
Lot.10, John's Parkway Subdivision, according to
the map or plat thereof as recorded in Plat Book
29, page 41 of the Public Records of Pinellas
County, Florida, together with abutting right-of-way.
The above described property is hereby designated
Fire District No. 2.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conform-
ance with the City's Comprehensive Plan and individual elements
thereof adopted pursuant to the LGCPA and directs that same be
forwarded to the LPA for their receipt and appropriate action.
Section 3. The City Commission hereby formally and according
to law, accepts the dedication of all easements, streets, parks,
plazas, places, rights-of-way and other dedications to bhe public
which fiaVe..heretofore been made by plat, deed or user within the
areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the
official maps and records of the City of Clear., ter the foregoing
.property and the fire district classification therefor. j
Section 5: This ordinance and notice of the proposed enactment y.f

circulation in accordance with Section 166.041, Florida Statutes,

Section 6. This ordinance shall become effective immediately
upon its passage and enrollmen t in the City of Clearwater Ordinance
Book and a copy thereof being filed by the City Clerk for recording
in the office of the Clerk of the Circuit Court of Pinellas County,
Florida. In accordance with S ection'171.091, and Section 171.044,
Florida Statutes, a certified copy shall be filed with the Depart-
ment of State of the State of Florida.
