AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1984, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMEN'T'; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.

WHEREAS, on February 16, 1984, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing
for the determination and establishment of zoning classifications
for certain property annexed into the City of Clearater in accordance
with procedure as established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning fob such newly annexed real property were approved
by the City Commission after its evaluation of all evidence presented
at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related.to an adopted comprehensive plan or element thereof,
be' reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required referral
process; and
WHEREAS, this ordinance has been referred to and considered
...by'the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section•1.'. The following described'property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and "The.Zoning Atlas'of the City of Clearwater, Florida of 198411,
as amended, is'.amended to indicate that fact as hereinafter set

That certain property described as the SW 1/4 of the
SW 1/4, less the North 330 feet thereof, of Section 16,
Township 28 South, Flange 16 East, less the right-of-
way of C.R. 593; also less and ecept any portion thereof
lying within the boundaries of the plat of Tanglewood
Estates, as recorded in Plat Book 75, page 25, Public
Records of Pinellas County, Florida, and being more
particularly described as follows:
Begin at the SW corner of Section 16, Township 28 South,
Range 16 East, Pinellas County, Florida; thence N 00°26'43"
W, for 1000.75 feet along the West boundary line of said
Section 16, said West boundary line also being the East
right-of-way line of Landmark Drive, as recorded in O.R.
Book 5328, on pages 1359-1361 of the Public Records of
Pinellas County, Florida to the SW corner of said plat
of Tanglewood Estates; thence leaving said East right--of-
way line S 89°33'58" E, for 1287.69 feet along the South
boundary line of said plat of Tanglewood Estates to a
point on the West right-of-way line of McMullen-Booth
Road (C.R. 593); thence S 00°23'56" E along said West
right-of-way line and along a line 50.00 feet West of and
parallel to the East line of the SW 1/4 of the SW 1/4
of said Section 16, for 999.22 feet to a point on the
South line of the SW 1/4 of said Section 16; thence
N 89°38'01'' W, along said South line, for 1286.86 feet
to the P.O.B.; less the East 50 feet thereof.
Section 2. The City of Clearwater does hereby certify that
the measures contained in this ordinance are consistent and in
conformance with the City's Comprehensive Plan and individual
elements thereof adopted pursuant to the LGCPA and directs that
same be forwarded to the LPA for their receipt and appropriate
action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be .invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been"properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.

Section 6. The Planning Director is directed to include and
set out and show upon the official zoning atlas of the City of
..Clearwater the foregoing amendment as hereinabove set out.

Section 7. Section 1 of.this ordinance shall, not become effective
"until the requisite authorization has been received from the Pinellas
County Planning Council pursuant to 4ts powers of Local. Planning
Agency review or Land Use Plan amendments, as is applicable.
