AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING A PORTION OF SECTION 16, TOWNSHIP 28 SOUTH,
RANGE 16 EAST, PINELLAS COUNTY, FLORIDA, INTO THE
CORPORATE LIMITS OF THE CITY OF CLEARWATER, FLORIDA,
AND REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITION ACCORDING TO THE PROVISIONS
.OF THE CHARTER OF THE CITY OF CLEARWATER, FLORIDA,
AND THE LAWS OF FLORIDA; AFTER PROPER PUBLIC NOTICE
AND PUBLIC HEARING THEREON, ESTABLISHING THE FIRE
DISTRICT CLASSIFICATION FOR SAID PROPERTY; PRO-
VIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Paula H. Hall, Sandra H. Johnson and
Carroll M. Nall, Jr. requesting the City to annex a certain parcel
of real estate described hereinafter, owned by them, into the
corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on December 15,
1983, voted unanimously to accept said request and authorized the
proper officials to set up a public hearing thereon for the deter-
mination and establishing of fire district classification and to
prepare an ordinance to annex said parcel of real estate into the
corporate'limits of the City of Clearwater in accordance with the
provisions of Chapter 171, Florida Statutes; and
WHEREAS, on February 16, 1984, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing
for'the determination and establishment of fire district classi--
fication for said real property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for conformance with
plans.adopted pursuant to the LGCPA; and
.WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required
referral process; and

WHEREAS, this ordinance has been referred to and considered
by the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at
a proper public hearing, the City of Clearwater, acting by and

through its City Commission, by the authority and under the pro-
visions of Section 171.044, Florida Statutes, hereby annexes into
the corporate limits of the City of Clearwater, Florida, and re-
defines the boundary lines of said City so as to include the -
,following described real property in Pinellas County, Florida, an .p
establishes fire district classification therefor:
That certain property described as the SW 1/4 of the
SW 1/4, less the North 330 feet thereof, of Section 16,
Township 28 South, Range 16 East, less the right-of-
way of C.R. 593; also less and except any portion thereof
lying within the boundaries of the plat of Tanglewood
Estates, as recorded in Plat Book 75, page 25, Public
Records of Pinellas County, Florida, and being more
particularly described as follows:
Begin at the SW corner of Section 16, Township 28 South,
Range 16 East, Pinellas County, Florida; thence N 00°26'4311
W,.for 1000.75 feet along the West boundary line of said
Section 16, said West boundary line also being the East
right-of-way line of Landmark Drive, as recorded in O.R.
Book 5328, on pages 1359-1361 of the Public Records of
Pinellas County, Florida to the SW corner of said plat
of Tanglewood Estates; thence leaving said East right-of-
way line S 89°33`58'' E, for 1287.69 feet along the South
boundary line of said plat of Tanglewood Estates to a
point on the West right-of-way line of McMullen-Booth
Road (C,R. 593); thence S 00°23'56" E along said West,
right-of-way line and along a line 50.00 feet West of and
parallel to the East line of the SW 1/4 of the SW 1/4
of said Section 16, for'999.22 feet to a point on the
South line of the SW 1/4 of said Section 16; thence
N 89°38'01" W, along said South line, for 1286.86 feet
to the P.O.B.; less the East 50 feet thereof.
The above described property is hereby designated
Fire'District No. 2.
Section 2. The City of Clearwater does hereby certify that
the measures contained in this ordinance are consistent and in con-
formance with the City's Comprehensive Plan and individual elements
thereof Adopted pursuant to the LGCPA and directs that same be
forwarded to the LPA for their receipt and appropriate action.
Section 3. The City Commission hereby formally and according
accepts the dedication of all easements, streets, parks,
plazas, places, rights-of-way and other dedications to the public

areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning
Dir,f7tor are directedto include and set out and show upon the official
maps and records of the City of Clearwater the foregoing property
and the'£ire district classification therefor.
Section 5. This ordinance and notice of the proposed enactment
of same has been properly advertised in a newspaper of general
circulation in accordancewith Section 166.041, Florida Statutes,
and Section 171.044, Florida Statutes.
Section 6. This ordinance shall become effective immediately
upon its passage and enrollment in the City of Clearwater Ordinance
Book and a copy thereof being filed.by the City Clerk for recording
in'the office of the Clerk of the Circuit Court of Pinellas County,
Florida. In accordance with Section 171.091, and Section 171.044,
Florida Statutes, a certified copy shall be filed with the Depart-
ment of.-State of the State of Florida.

WHEREAS, Chia Ordinance his been referred to and considered
by the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at
a proper public hearing, the City of Clearwater, acting by and
through its City Commission, by the authority and under the pro-
_ .vis?.ons of Section 171.044, Florida Statutes, hereby annexes into
the corporate limits of the City of Clearwater, Florida, and re-
defines the boundary lines of said City so as to include the
following described real property in Pinellas County, Florida, an
establishes fire district classification therefor:

which have heretofore been made by plat, deed or user within the
areas so annexed.
Section 4. The City Engineer, the City Cleric and the Planning
Direc:,or are directedto include and set out and show upon the official
maps and records of the City of Clearwater the foregoing property
and the fire district classification therefor.
Section 5., This ordinance and notice of the proposed enactment
of same has been properly advertised in a newspaper of general
circulation in accordancewith Section 166.041, Florida Statutes,
and Section 171.044, Florida Statutes.
Section 6. This ordinance shall become effective immediately
upon its passage and enrollment in the City of Clearwater Ordinance
Book and a copy thereof being filed by the City Clark for recording
in the office of the Clerk of the Circuit Court.of Pinellas County,
Florida. In accordance with Section 171.091, and Section 171.044,
Florida Statutes, a certified copy shall be filed with the Depart-
ment of State of the State of Florida.
