AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 50, IN GENERAL, OF TITLE V, UTILITIES,
OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, BY
CLARIFYING THE DEFINTIONS OF APPLICANT, CONSUMER AND
CUSTOMER; PROVIDING A DEFINITION FOR OWNER; PROVIDING
CLARIFICATION OF PROVISIONS FOR APPLICATION FOR
SERVICE AND FOR NEW SERVICE CONNECTIONS; CHANGING
METHOD FOR DEFECTIVE AND UNREAD METERS; PROVIDING
FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, it is necessary to amend the current code to clarify the present
system under which utility services are provided; and
WHEREAS, it is the desire of the City Commission that language be
clarified.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND
REGULARLY ASSEMBLED, AS FOLLOWS:
Section 1. That Section 50.02, Definitions, of Chapter 50, In General, of
Title V, Utilities, of the Code of Ordinances, City of Clearwater, be and the same is
, hereby amended by specifically amending the definitions of the terms applicant,
consumer, and customer to read as follows:
Sec. 50.02., Definitions.
Applicant shall mean the person that owns the property where utility
services are requested or the person that nets with the property
owner's knowledge and consent and demonstrates that he possess
autherityf to bind the owner for any or all utility service evade
avagablo to the property the went for the owner" Also known as
"customer."
Consumer shall mean the person who aetual y receives and utilises
services at a specific location customer.
Customer shall mean the person responsible for payment for all
utility services used at a specific location, of one household or
business, and further defined as that person who signed the
application either as owner or with the owner's knowledge and
consent and havf:rg the demonstrated authority to bind the owner;
requeating utility services be evade available at the speeifie loeation
and thereby agreeing as owner er on behalf of the owner to pay for
all usage of such services oeeurring at the leeation as the went for
the owner.
Section 2. That Section 50.02, Definitions, of Chapter 50, In General, of
Title V, Utilities, of the Code of Ordinancep, City of Clearwater, be and the same is
hereby supplemented by the addition of the following definition:

Owner shall mean the person, corporation, partnership or other entit
that holds title to the real property receiving utilit services.

(c)(5) as follows:

Water, gas, sanitation. Every applicant who wishes to
have property furnished with water, gas and sanitation
services shall be required to make an application in
writing to the director of the utilities department in a
format approved by the city manager. The application
form shall set forth the location of the property (lot
number, subdivision, address and any forwarding address,
and paying address if different from the address serviced),
numbers and size of meters required, size of service line,
whether the building is old or new, building permit number
and the name, address and phone number of the customer.
The application form shall a4so contain a space to be
signed by the owner of the property (premises) which shall
be in the form of an acknowledgment that the owner has
read or is familiar with the previsions of section 56:98 and
is thereby aware that as owner he 49 responsible for aR
utility serv4ee charges or the agent for the owner. Such
application shall also set forth the provisions of section
50.03 In raised type.
Water, sewer-, gas and sow waste eelleetien service are
utilities held to be furnished to the property as provided
in seet4en 59:98; and the fees,- therefore; are chargeable

Section 5. That Section 50.06, Accounts due; method of billing and when
delinquent, of Chapter 50, In General, of Title V, Utilities, of the Code of Ordinances,
City of Clearwater, be and the same is hereby amended to read as follows:
See. 50.06. Accounts due; method of billling andrwhen delinquent.
All meters shall be read monthly and bills for all charges shall be
rendered. Where the water meter on any premises is defective or the
property owner customer has prevented the meter from being read,
then the ewner customer shall pay for that month an amount equal to
the average amount charged for the two months preceding and the
taenth €ellowing the failure of the water, meter or failure to, read the
water meter. Charges for each service shall be arranged as separate
items on all such bills. The bill shall be mailed or delivered to the
customer monthly either as a separate bill or in conjunction with
other utility bills. Failure to receive a bill shall not constitute a
defense for nonpayment. Any bill which remains unpaid on and after
fifteen (15) days from the date of sabmiss{en rendered shall be
considered delinquent and service to the customer may be
terminated. Where it is proposed to terminate utility service to a
customer, notice shall first be sent to such customer,, and by prier
€Red request; netiee wilt be sent property owner of reeerdl; which
netiee shaR advise the eustsmer advising that the account is
delinquent;. The notice shall provide the amount of such delinquency
and advise the customer that the service will be discontinued five (5)
days from the date of such notice Is rendered unless the customer
within such time pays such account or appeals the decision to
terminate the service to the city manager. An appeal to the city
manager shall be commenced by the customer filing a written request
with the director of the utilities department within five (5) days of
the rendered date of the notice provided for herein. Complaints
relating to bills shall be made before the due date shown on the bill.
Where the customer has not been billed for services rendered, the
city shall have the right to back-bill for any such services.
Section 6. Should any part or provision of this ordinance be declared by a
court of competent jurisdiction to be invalid, the same shall not affect the validity of
the ordinance as a whole, or any part thereof other than the part declared to be
invalid.
Section 7. All ordinances or parts of ordinances in conflict herewith are
to the extent of such conflict hereby repealed.
Section 8. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance with Section
166.041, Florida Statutes.
Section 9. The provisions of this ordinance shall take effect immediately
upon its passage.
