3429-84 ORDINANCE NO. 3429-84 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ANNEXING A PORTION OF SECTION 23, TOWNSHIP 29 SOUTH, RANGE 15 EAST, PINELLAS COUNTY, FLORIDA, INTO THECORPORATE LIMITS OF THE CITY OF CLEARWATER, FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION ACCORDING TO THE PRO- VISIONS OF THE CHARTER OF THE CITY OF CLEARWATER, FLORIDA, AND THE LAWS OF FLORIDA; AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING THEREON, ESTABLISHING f THE FIRE DISTRICT CLASSIFICATION FOR SAID PROPERTY; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission of the City of Clearwater, Florida, received a sworn petition from James F. Nelson, Marian N. Snowden, Sarah H. Campbell Waldon and The First National Sank of Clearwater as Trustee for Florine Nelson, requesting the City to annex a certain parcel of real estate described hereinafter, owned by them, into the corporate limits of the City of Clearwater, Florida; and WHEREAS, the City Commission, after due consideration of said request for annexation, at a regular meeting held on December 8, 1983, voted unanimously to accept said request and authorized the proper officials to set up a public hearing thereon for the determination and establishing of fire district classification and to prepare an ordinance to annex said parcel of real estate into the corporate•2 limits of the City of Clearwater in accordance with the provisions of Chapter 171, Florida" Statutes; and WHEREAS, on January 19, 1984, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of fire district classification for said real property; and WHEREAS, the Local Government Comprehensive Planning Act F. (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and Ord; :3429-84 ' 3-15-84 A z 1=A1:7. ;n` 5 t?lx C z WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. After: its evaluation of all evidence presented at a proper public hearing, the City of Clearwater, acting by and through its City Commission, by the authority and under the provisions of Section 171.044, Florida Statutes, hereby annexes into the corporate limits of the City of Clearwater, Florida, and redefines the boundary lines of said City so as to include the following described real property in Pinellas County, Florida, and establishes fire district classification therefor: start:, at the NE corner of the SE 1/4 of the SW 1/4 of Section 23, Township 29 South, Range 15 East; thence proceed N 89°05'20" W along the centerline of Nursery ,Road, said line being the North line of the SE 1/4 of the SW 1/4 of Section 23, 396.99 feet; thence S 0°54'40" W, 50.00 feet to the P.O.B.; from said P.O.B. proceed S 0°21'39"E, said line being the West boundary of Belleair Park Estates as recorded in Plat Book 63, page 39 of the Public Records of Pinellas County, Florida, 375,00 feet; thence N 89°05'20" W, 276.43 feet; thence S 0° 20',33" E, 240.41 feet; thence N 89°05'20" W, 125.99 feet; thence N 00°20'33" W, 615.41 feet, to the South right-of-way of Nursery Road, said road having a 100 foot right-of-way; thence proceed S 89°05'20" E, along said right-of-way, 402.30 feet to the P.O.B. The above described property is hereby designated Fire District No. 2. Section 2. The'City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. 3.-15-84 :l. The City Commission hereby formally and according to law, accepts the dedication of all easements, streets, parks, plazas, places, rights-of-way and other dedications to the public which have heretofore been made by plat, deed or user within the areas so annexed. Section 4. The City Engineer, the City Clerk and the Planning Director are directed to include and set out and show upon the official maps and records of the City of Clearwater the foregoing property and the fire district classification therefor. Section 5. This ordinance and notice of the proposed enactment of same has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes, and Section 171.044, Florida Statutes. Section 6. This ordinance shall become effective immediately upon its passage and enrollment in the City of Clearwater Ordinance Book and a copy thereof being filed by the City l Clerk for recording in the office of the Clerk of the Circuit Court of Pinellas County, Florida. In accordance with Section 171.091, and Section 171.044, Florida Statutes, a certified copy shall be filed with the Department of State of the f , State of Florida.
