ORDINANCE NO. 3392-M
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING SECTION 93.23, AMENDMENTS, OF ARTICLE 11, FIRE
PREVENTION CODE, OF CHAPTER 90, IN GENERAL, OF TITLE
VIII, PUBLIC HEALTH AND SAFETY, OF THE CODE OF
ORDINANCES, CITY OF CLEARWATER, TO REGULATE
MATERIAL SPECIFICATIONS OF UNDERGROUND "PETROLEUM"
TANKS; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, most underground tanks for storing petroleum and other
flammable liquids are constructed of steel; and
WHEREAS, steel corrodes both from the inside and the outside in Florida
due to the high water table and frequent intrusions of salt water into the table; and
WHEREAS, when a steel tank corrodes, leaks form and the petroleum and
other liquids in the tank enter the soil and water surrounding the tank; and
WHEREAS, there have been several instances where gasoline and other
petroleum products pumped into the Clearwater storm sewer system while dewatering
the ground surrounding a badly corroded steel tank during tank replacement; and
WHEREAS, gasoline and other petroleum products in the storm sewer
system is dangerous to the community if explosive concentrations are reached and
dangerous to the environment because of the toxic effects of such liquids particularly
in confined areas such as creeks and ponds where evaporation is restricted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 93.230 Amendments, of Article 11, Fire Prevention
Code, of Chapter 90, In General, of Title Vlll, Public Health and Safety, of the Code of
Ordinances, City of Clearwater, be amended to add a paragraph after Section 13.2,
..Definition, as follows:
Section 16.2 1, Design and construction of tanks, Is amended to
read as follows:
a. Materials.
(1) Tanks shall be built of steel except as provided by the
provisions of Sections 16.21a(2) through 16.21a(5 7).
(2) ' Tanks are permitted to be built of materials other than
steel:
(a) if required by the properties of the liquid stored. In
case of doubt, the supplier, producer of the flammable or
combustible liquid, or other competent authority shall be

consulted as to the suitability of the material of construction to
be used;

(e b) If used for storage of Class 11113"iquids aboveground
Ih areas not exposed to a spill or leak of a Class I or Class li
liquid. .1f tanks storing Class II113 liquids are located where they
are exposed to a spill or leak of a Class I or Class II liquid, they
shall be constructed in accordance with Section 16.21c; or
(d c) If used for the storage of Class 11113 liquids inside a
building protected by an approved automatic fire extinguishing
system.
(3) Tanks built of materials other than steel shall be designed
to specifications embodying principles recognized as good engineering
design for the material used and shall be approved by the Chief of the
bureau of Fire Prevention.
(4) Unlined concrete tanks are permitted to be used for
storing flammable or combustible liquids having a gravity of 40
degrees API or heavier. Concrete tanks with special lining are
permitted to be used for other services providing the design is in
accordance with sound engineering practice.
(5) Tanks can have combustible or noncombustible linings.
(6) Special engineering consideration shall be required if the
specific gravity of the liquid to be stored exceeds that of water or if
the tanks are designed to contain flammable or combustible liquids at
a liquid temperature below zero degrees F.

cathodically protected steel; double-walled steel or plastic; or other

b. Fabrication.
(I) Tanks are permitted to be of any shape or- type consistent
with sound engineering design and consistent with subsection a.(7)
above.
(2) Metal tanks shall be welded, riveted and caulked, brazed,
or bolted, or constructed by use of a combination of these methods.
Section 2. Should any part or provision of this ordinance be declcred by a
„ court of competent jurisdiction to be invalid, the same shall not affect the validity of
the ordinance as a whole, or any part thereof, other than the part dec;ared to be
Invalid.
Section 3, All ordinances or parts of ordinances in conflict herewith are
to the extent of such conflict hereby repealed.

Section 4. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper or general circulation In accordance with Section
166.041, Florida Statutes.
Section 5. The provisions of this ordinance shall take effect immediately
upon its passage.
