3353-84t?m?':^sf,i•?.'?'+'?1"rr?`"?+'say,'?;7s;:.mn?l;;?^''f?`"'.?yr.r4+?, 4?`?n ,i; ry. ;?,?.i.:3..'S'Y.. ,...? ?r.'':........ .,... ...s4`.?zt':.t''..•,X:.''°. .. .'f°y:l;'???;?.4`; t?,lh, a n ORDINANCE NO. 3353-84 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE NO. 2019, RELATING TO THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN, TO CHANGE THE LAND USE DESIGNATION FOR CERTAIN REAL PROPERTY WITHIN THE CITY OF CLEARWATER; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS,' this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Pursuant to the provisions of the Local Government Comprehensive Planning Act, 1975, as amended, and pursuant to all applicable'pro- visions'of law, Section 1 of Ordinance No. 2019 is amended by placing the hereinafter described property in the land use category as follows: Property (L.U.P. 83-50) Commence at the Northwest corner of the Southwest 1/4 of Section 2-29-15, thence S 89°29' 42" E, 330 feet; thence S 00° 081 17" E, 50 feet to the South right-of-way line of Sunset Point Road, for a point-of-beginning; thence S 89° 2914211 E, along said South right-of-way line to a point, said point lying 200 feet West of and 50 feet South of the Northeast corner of the Northwest 1/4 of the Southwest 1/4 of said Section 2; thence South to 'a point, said point lying on the Easterly. extension of the North boundary of Brentwood Estates as recorded in Plat Book 59, page 28, of the Public Records of Pinellas County, Florida; thence Westerly to the Northwest corner of Lot 19 of said Brentwood Estates; thence N 0° 08' 17" W, 167.13 feet to the point of beginning. AND Land Use Category From: Medium Density Residential and Commercial/Tourist Facilities To: Tracts B and C, Brentwood Estates, according to map or plat thereof, as recorded in Plat Book 59, page 28, of the Public Records of Pinellas County, Florida. The City of Clearwater does hereby certify that the measures contained to this ordinance are consistent and in conformance with the City's Comprehensive Plan and Individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances In conflict herewith are to the extent of such conflict hereby repealed. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect immediately upon its passage.
