AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 138, HOUSING CODE, OF TITLE XI,
BUILDING AND ZONING REGULATIONS, OF THE CODE OF
ORDINANCES, CITY OF CLEARWATER, BY ENACTING A
NEW SECTION 310 TO THE STANDARD HOUSING CODE TO
REQUIRE COMPLIANCE OF ALL HOTELS, MOTELS, DORM-
ITORIES AND LODGING HOUSES AND TO SET FORTH REQUIRE-
MENTS THEREFOR; PROVIDING FOR THE REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed
by the Local Planning Agency (LPA) for conformance with plans. adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to each required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 138. 01, Standard Housing Code adopted,
of Chapter 138, Housing Code, of Title XI, Building and Zoning Regulations,
of the Code of Ordinances, City of Clearwater, be and the same is hereby
amended and supplemented by the addition to such Code of a new Section
310 to read as follows,
Section 310. Hotels, motels, dormitories and lodging houses.-
Sec. 310.1 Compliance with this section required.
No person shall occupy or shall let to another for occupancy
any hotel, motel, dormitory, guesthouse or lodging house which
does not comply with the requirements of this section.

Sec. 310.2 Toilet and bathing facilities.
(a) There shall be located on each floor at least one
(1) water closet, one (1) lavatory basin and one (1)
bathtub or shower properly connected to an approved
potable water supply and sewage disposal system and
in good working condition for each eight (8) persons or
less residing witin the residential occupancy, including
members of the owner's or agent's family wherever they
share the use of such facilities; however, in a resident-
ial occupancy where rooms or rooming units are let only
to males, flush urinals may be substituted for not more
than one--half (1/2) of the required number of water
closets.
(b)-All facilities required by subparagraph (a) shall be
located within the building or structure and shall be
reasonably accessible from a common hall or passageway to
all persons sharing the facilities. Each lavatory basin,
bathtub or shower shall be supplied with hot water in
accordance with the provisions of this Code. No such
facilities shall be located within a basement except by
written approval of the building official.
Sec'.' 310.3 , Light' and ventilation.
The minimum requirements for light and ventilation as set
.forth in'Sectin 303 of the Standard Housing Code, 1979
Edition, with 1980-81 Revision, shall apply to any resi-
dential occupancy used or intended to be used subject to
this section.
Sec. 310.4 Space, use and occupancy.
The minimum requirements for space, use and occupancy as
set forth in Section 306 of the Standard Housing Code, 1979
Edition, with 1980-61 Revision, shall apply to any resi-
dential occupancy used or intended to be used subject to
this section.
Sec. 310.5 Means of egress.
Each residential occupancy used or intended to be used
subject to this section shall be provided with means of
egress as provided by the building code of the City of
Clearwater.
Section 2. The City of Clearwater does hereby certify that the-
measures contained in this ordinance are consistent and in con-
formance with the City's Comprehensive Plan and individual elements.
thereof adopted pursuant to the LGCPA and directs that same be
forwarded to the LPA for their receipt and appropriate action.
Section 3. Should any part or provision of'this ordinance be
'declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.

Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Notice of the proposed enactment of this ordinance has
been ,properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage,
