ORDINANCE NO. 3339-84
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OP CLEARWATER, FLORIUA,198'4, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, on October 6, 1983, and on December 8, 1983,
theCity Commission of the City of Clearwater, after proper
public notice,held-public hearings for the determination and
establishment of zoning classifications for certain property
annexed into the City of Clearwater in accordance with procedure
as established; and
WHEREAS, certain of the amendments to the zoning atlas
for establishing zoning for such newly annexed real property
were approved by the City Commission after its evaluation
of all evidence presented at the said public hearings; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to ari adopted comprehensive plan or element
thereof be reviewed by the Local Planning Agency (LPA) for
conformance with plans adopted pursuant to LGCPA; and
WHEREAS, the Pinellas County Planning'Council (PCPC) has
been designated the-Local Planning Agency for Pinellas County
and'!-he PCPC has adopted guidelines with reference to such
required referral process; and
WHEREAS, 'this Ordinance has been referred to and considered
by the..PCPC under"said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,

and "The Zoning Atlas of'the City of Clearwater, Florida of
198j",-as amended, is amended to indicate that fact as hereinafter
set out:
Zoned RMH - Mobile Home Park District
A parcel in the SE 1/4 of the SE 1/4 of Section 18, 't'own--
ship 29 South, Range 16 East, Pinellas County, Florida,
further described as follows:
.Start With the SE corner of the said Section 18-29-16
also a point along the right-of-way centerline of U.S.
19(S.R. 55), and run thence N 88°57'10" W, 300.00 feet
for a P.O.H.; thence continue along the said line N 88°
57110" W, 791.24 feet to the easterly line of Florida
Power Corp. right-of-way; thence along the said line
N 01°22'22" E, 1,036.39 feet; thence S 89°19'03" E,
710.44 feet; thence S 01°03'04" W, 184.51 feet; thence
S 89°19'03"E, 75.00 feet; thence S 01°03'04" W, 856.86
feet to the P.O.B.
Section 2. The City of Clearwater does hereby certify
that the measures contained in this ordinance are consistent
and in conformance with the City's Comprehensive Plan and
individual elements thereof adopted pursuant to the LGCPA
and directs that same be forwarded to the LPA for their receipt
and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the ordinance as
a whole, or any part thereof other than the part declared
to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been properly'advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6: The Planning Director is directed to include

and'set out and show upon the official zoning atlas of the
city of.Clearwater the foregoing amendment as hereinabove
set out.'.

Section 7. Section 1 of this Ordinance shall not become
effective until the requisite authorization has been received
from the Pinellas County Planning Council pursuant to its
powers of Local Planning Agency review or Land Use Plan amend-
ments, as is applicable.
