ORDINANCE NO. 3338-84
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1984, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN) PROVIDING FOR REPEAL OF
ALL ORDINANCES Olt PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on October 6, 1983, and on December 8, 1983,
the City Commission of the City of Clearwater, after proper
public notices, held public hearings for the determination
and establishment of zoning classifications for certain property
annexed into the City of Clearwater in accordance with procedure
as established; and
WHEREAS, certain of the amendments to the zoning atlas
for establishing zoning for such newly annexed real property
were approved by the City Commission after its evaluation
of all evidence presented at the said public hearings; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amend-
ments thereto related to an adopted comprehensive plan or
element thereof be reviewed by the Local Planning Agency
(LPA) for.conformance with plans adopted pursuant to LGCPA;
and .
WHEREAS, the Pinellas County Planning Council (PCPC) has
been designated'the Local Planning Agency for Pinellas County
and the PCPC has adopted guidelines with reference to such
required referral process; and
WHEREAS, this Ordinance has been referred to and considered
by.the PCPC under said process;
NOW; THEREFORE,.BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

198411, as amended, is amended to indicate that fact as hereinafter
set out:
Zoned PS Professional Services District
A parcel in the SE 1/4 of the SE 1/4 of Section 18,
Township 29 South, Range 16 East, Pinellas County, Florida,
further described as follows:
Start With the SE corner of the said Section 18-29-16
also a point along the right-of-way centerline of U.S.
19 (S.R. 55), and run thence N 88°57'10" W, 100.00 feet
to a point along the westerly right-of-way line of the
said U.S. 19; thence continue along the said line
N 88°57'10" W, 200.00 feet; thence N 01°03'04" E, 856.86
feet; thence N 89°19'03" W, 75.00 feet; thence N 01°03'
04" E, 184.51 feet for a P.O.B.; thence run N 89°19'03"
W, 710.44 feet to the easterly line of Florida Power
Corp. right-of--way; thence along the said line N 01°
22122" E, 250.02 feet to the southerly right-of-way line
of Druid Road; thence along the said line S 89°19'03"
E, 400.00 feet; thence S 01°22'22" W, 100.01 feet; thence
S 89°19'03" E, 384.60 feet; thence.S 01°03'04" W, 100.00
feet; thence N 89°19'03" W, 75.00 feet; thence S 01°03'04"
W, 50.00 feet to the P.O.B.

Section 2. The City of Clearwater does hereby certify
that the measures contained in this ordinance are consistent
and in conformance with the City's Comprehensive Plan and
individual elements thereof adopted pursuant to the LGCPA
and directs that same be forwarded to the LPA for their receipt
and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4, Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect- the validity of the ordinance as
a whole, or any part thereof other than the part declared
to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include
and set out and show upon the official zoning atlas of the
'City of Clearwater the foregoing amendment as hereinabove'

Section 7. Section 1 of this Ordinance shall not become
effective until the requisite authorization has been received
from the Pinellas County Planning Council pursuant to its
powers of Local'Planning Agency review or Land Use Plan amendments+
as is applicable.
