AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
SUPPLEMENTING CHAPTER 133, BUILDING CODE, OF
TITLE XI, BUILDING AND ZONING REGULATIONS, OF THE
CODE OF ORDINANCES, CITY OF CLEARWATER, TO ADOPT
ANEW SECTION 133.13, THRESHOLD BUILDINGS, SETTING
FORTH THE PROCEDURE TO BE UTILIZED TO COMPLY
WITH CHAPTER 83-160, LAWS OF FLORIDA; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT:
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed
by the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to each required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Chapter 133, Building Code, of Title XI, Building
and Zoning Regulations, of the Code of Ordinances, City of Clearwater,
be and the same is hereby amended and supplemented by the addition of
Section 133. 13, Threshold Buildings, to read as follows:
Sec. 133.13. Threshold Buildings.
Any building classified as a "Threshold Building" under
the provisions of Chapter 83-160, Laws of Florida, as
defined by such Chapter and interpreted by the Florida
Board of Building Codes and Standards shall with regard
to the issuance of building permits, special inspections
during construction, and the issuance of certificates of
occupancy be subject to the following procedure:
1'. The owner of any proposed building classified as a
"Threshold Building" must engage a special inspector
to conduct all inspections required by Chapter 83-160,

2. Prior to the issue of a Building Permit, the special
inspector must file with the Building Inspection Department
on a form designed for that purpose and furnished by the
Building Inspection Department, an affidavit attesting
under the provisions of Chapter 83-160, Laws of Florida.
3. Throughout the course of construction the special inspector
must submit to the Building Inspection Department a weekly
report listing all structural elements put in
place during the previous week for which inspection is
required under Chapter 83-160, Laws of Florida. The
report must state that the placement of all such
at elements were observed by him or her and
found to comply with plans and codes. The report must
bear the signature of the special inspector and is due on or
before Wednesday following the week reported, and failure
of the special inspector to file the weekly report by 4:00 P. M.
on Friday following the week reported will be considered due
cause for the Building Inspection Department to order
construction stopped until all necessary reports have been
filed.
4. Upon completion of construction of the Threshold
Building, and prior to the issue of a certificate of
Occupancy, the special inspector and the contractor must
file with the Building Inspection Department, on a form
designed for that purpose and furnished by the Building
Inspection Department, affidavits attesting that all require-
ments of Chapter 83-160, Laws of Florida, have been
complied with.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance
with the City's Comprehensive Plan and individual elements thereof adopted
pursuant to the LGCPA and directs that same be forwarded to the LPA for
their receipt and appropriate action.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the. ordinance as a whole, or any part thereof'other than the
part declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed. "
Section 5. 1 tice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes.
