3191-83 ORDINANCE NO. 3121_83 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, DELETING A PORTION OF SECTION 21, TOWNSHIP 28 SOUTH, RANGE 16 EAST, PINELLAS COUNTY, FLORIDA, FROM THE CORPORATE LIMITS OF THE CITY OF CLEARWATER, FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO SHOW SUCH DELETION ACCORDING TO THE PROVISIONS OF THE CHARTER OF THE CITY OF CL I,ARWATER, FLORIDA, AND THE LAWS OF FLORIDA, AND AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING THEREON; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO- VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission of the City of Clearwater, Florida, received a sworn petition from the City of Safety Harbor, Florida, requesting the City to delete a certain parcel of real estate described hereinafter, owned by it, from the corporate limits of the City of Clearwater, Florida; and WHEREAS, the ?tify" Commission, after due consideration of said ,request for deletion, at a regular meeting held on May 19. 1983, voted unanimously to accept said request and authorized the proper officials to set up a public hearing thereon and?,to prepare an ordinance to delete said parcel of real estate from the corporate limits of the City of Clearwater in accordance with the provisions of Chapter 171, Florida Statutes; and WHEREAS, on July 7, 1983, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the purpose of deletion of said real property; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; -I- 9-15-83 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. After its evaluation of all evidence presented at a proper public hearing, the City of Clearwater, acting by and through its City Commission, by the authority and under the provisions of Section 171.051, Florida Statutes, hereby deletes from the corporate limits of the City of Clearwater, Florida, and redefines the boundary lines of said City so as to show such deletion of the following described real property in Pinellas County, Florida: Commence at the NW corner of the NE 1 /4 of the SW 1 /4 of Section 21, Township 28 South, Range 16 East; thence S 89.22'43"'E, 50.00 feet; thence S 0103120" E, 30. 00 feet to the P. O. B.; thence S8902214311 E, 435.60 feet; thence S 0.03120" E, 200. 00 feet; thence N 89'22'43" W, 435.60 feet- thence N 0.03120" W, 200. 00 feet to the P. O. B. , together witfi abutting 100 ft. wide right-of-way of McMullen-Booth Rd. Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and indivit.aal elements thereof adopted pursuant to the LCCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. The City Engineer, the City Clerk and the Planning Director are directed to show upon the official maps and records of the City of Clearwater the deletion of the foregoing property. Section 4.
