ORDINANCE NO. 3289-83
AN ORDINANCE AMENDING-THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1983, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on July 7, 1983, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment 'of zoning classifications for certain
property annexed into the City of Clearwater in accordance with procedure
as established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were approved by
the City Commission after its evaluation of all evidence presented at the
said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by
the Local Planning Agency (LPA) for conformance with plans adopted pursuant
to LGC PA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC has
adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Sectioni. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and 'The Zoning

Atlas of the City of Clearwater, Florida of 1983, as amended, is amended
to indicate that fact as hereinafter set out:
Zoned CP - Parkway Business District
That part of the SW 1/4 of the SW 1/4 of Section 5,
Township 29 South, Range 16 East, being further described
as follows: From the SW corner of the SW 1/4 of the
SW 1/4 of said Section 5, run thence S 89°4010911 E, along,
the Section Line, 387. 51 feet; thence N 1°08145" E, 430.0
feet; thence N 9 ° 1915511 W, 143.94 feet for the P. O. B. ;
thence continue N 9 ° 19 t 55" W, 6. 30 feet; thence N 0.58145" E,
118.80 feet; thence S 88 ° 51' 15" E, 172.59 feet to the
Westerly line of Pinellas Terrace Firat Addition, as recorded
in Plat Book 54, page 70 of the Public Records of Pinellas
County, Florida; thence S 0°56'07" W, along said Westerly
line, 125. 0 feet; thence N 88 5111511 W, 171. 55 feet to
the P. O. B.
Section 2. The City of Clearwater does hereby certify that the measures
contained in this ordinance are consistent and in. conformance with the City-1s'
Comprehensive Plan and individual elements thereof adopted pursuant to
the LGGPA and directs that same be forwarded to the LPA for their receipt
and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict herewith
are.to the extent of such conflict hereby repealed.
-Section 4. Should any part or provision of this ordinance be declared
by. a, court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in an ewspaper of general circulation in accordance
ith Section 166.041, Florida Statutes.
,Section 6. The Planning Director is directed to include and set out
t ;... aizd show upon the official zoning atlas of the City of 'Clea rwater the foregoing
amendment°as hereinabove set out.

Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
