AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING A PORTION OF SECTION 18, TOWNSHIP 29 SOUTH,
RANGE 16 EAST, PINELLAS COUNTY, FLORIDA, TOGETHER
WITH ABUTTING STREETS, INTO THE CORPORATE LIMITS
OF THE CITY OF CLEAR WA TER, FLORIDA, AND REDEFINING
THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID
ADDITION ACCORDING TO THE PROVISIONS OF THE CHARTER
OF THE CITY OF CLEARWATER, FLORIDA, AND THE LAWS
OF FLORIDA; AFTER PROPER PUBLIC NOTICE AND PUBLIC
HEARING THEREON, ESTABLISHING THE FIRE DISTRICT
CLASSIFICATION FOR SAID PROPERTY; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from David Healey, Planning Director of the City
of Clearwater, Florida, requesting the City to annex a certain parcel of real
estate described hereinafter, owned by it, into the corporate limits of the
City of Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on January 14, 1982, voted
unanimously to accept said request and authorized the proper officials to set
up a public hearing thereon for the determination and establishing of fire
district classifications and to prepare an ordinance to annex said parcel of
real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on February 18, 1982, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said real
property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by the
Local Planning Agency (LPA) for conformance with plans adopted pursuant
to the LGCPA; and

WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC has
adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 171. 044,
Florida Statutes, hereby annexes into the corporate limits of the City of
Clearwater, Florida; and redefines the boundary lines of said City so as
to include the following described real property in Pinellas County, Florida,
and establishes fire district classification therefor:
From the NW corner of the NW 1/4 of the NW 1/4 of
Section 18, , Township 29 South, Range 16 East, thence
S 89°22'5111 E, along the centerline of Drew Street,
553.20 feet; thence S 00°1810511 W, 50.0 feet to a P. 0. B.;
thence S 89°2215111 E, 220.00 feet; thence S 00°18'0511 W,
220.00 feet; thence N 89°22,5111 W, 220.00 feet; thence
N 00 ° 1810511 E, 220.00 feet to the P. O. B.
AND
From the NW corner of the NW 1/4 of the NW 1/4 of
Section 18, Township 29 South, Range 16 East, thence
S 89°2215111 E, 'along the centerline of'Drew Street,
553. 20 feet; thence S 00°1810511 W, 270. 00 feet to the
P. 0. B. ; thence S 89°2215111 E, 220. 00 feet; thence
S 0001810511 W, 138,60 feet; thence N 89°2215111 W,
220.00 feet; thence N 00°1810511 E, 138.60 feet to the
P. O. B.
Together with all abutting streets.
The above described property is hereby designated
' Fire District No. 1.
Section 2` The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance with
.the City'.s Comprehensive Plan axid individual elements thereof adopted pursuant
to the. LGCPA and directs that same be forwarded to the LPA for their receipt
and appropriate action.

Section 3. The City Commission hereby formally and according to
law, accepts the dedication of all easements, streets, parks, plazas, places,
rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 5. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Section 166. 041, Florida Statutes, and Section 171. 044,
Florida Statutes.
Section 6. This ordinance shall become effective immediately upon
its passage and,enrollment in the City of Clearwater Ordinance Book and
a copy. thereof being filed in the office of the Clerk of the Circuit Court of
Pinellas County, Florida. In accordance with Section 171, 091, and Section
171. 044, Florida Statutes, a certified copy shall be filed with the Department
of. State. of the State of Florida.
