ORDINANCE NO. 265L-82
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING AND SUPPLEMENTING CHAPTER 20, IN GENERAL,
OF TITLE II, ADMINISTRATION, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, BY ENACTING NEW SECTIONS TO
PROVIDE FOR APPOINTMENT OF DEPUTY CITY CLERKS
AND DUTIES; PROVIDING FOR FORM OF OATH OF OFFICE;
PROVIDING FOR OFFICIAL BONDS; PROVIDING FOR IN-
VESTIGATIONS; PROVIDING FOR GENERAL LAW APPLICATION;
PROVIDING FOR THE REPEAL OF SECTIONS 57, 159, 160,
192 AND 197 OF CHAPTER 9710, SPECIAL ACTS OF FLORIDA,
1923; PROVIDING FOR SEPARABILITY OF THE PROVISIONS.
HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, Ordinance No. 1830 established a new Charter for
the City of Clearwater, Florida; and
WHEREAS, certain sections of the Old Charter became ordinances
subject to legislative action; and
WHEREAS, it is desired to place several of these sections in the
new codified Code of Ordinances;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Chapter 20. In General, of Title II, Administration,
of the Code of Ordinances, City of Clearwater, be and the same is hereby`!
amended and supplemented by the following sections to read as follows:
"Section 20.02. A ointment of De u City -Clerk

Section 20.04.• Official Bonds.
The city_ commission or the city manager, in fixing the
salary or compensation of any officer, clerk or employee,
shall determine whether or not such officer, clerk or
employee shall give bond, and if so, the amount thereof;
provided, that the city commission may rescribe which
of such or whether an. of such officers and employees
shall give bond, where bond is required the same shall be
procured from a regularly accredited surety company
authorized to do business under the laws of Florida, the
premium on such bonds to be paid by the city. All such
bonds shall be payable to the City of Clearwater, and shall
be filed in the office of the ci finance director.
Section 20.05. ' Investigations.
The city commission, or any committee thereof, the city
manager, or any advisory board appointed by the city
commission suchLurpose, shall have the power at'a
time to cause the affairs of any department or the conduct
of any officer or emElovee of the city_,_to be investigated;
and for such ur ose shall have the power to compel the
attendance of witnesses and the production of books a era
and other evidence; and for that purpose may issue subRoenas
or 'attachments which shall be signed by the presiding officer
of the body, or_by the officer making the investigation, and
shall be served b ' an officer authorized by law to serve such _
process. The authority making such investi ation'shall have
the power to cause testimony, to be given under oath, such
oath to be administered by some officer_ having authority
under the law of'the state to administer oaths; and 9hall have
the power to punish as 'for contempt an person failing or
refusing to testify to,any fact within his',or her knowledge or
to produce an book or paper under his or her care or control
relating to the matter under investigation.
Section' 20. 06. General Laws Application to City,
All general laws of the?atate applicable to municipal cor
now existing or which may hereafter be enacted shall be
a licable to the cif:- in the manner rovided b Section

Section 20.03. Oath of Office.
Every officer of the city shall, before entering upon the
duties of the office, take and subscribe to an oath or
affirmation to be filed and kept in the office of the city
clerk, which oath shall be in the form prescribed for
state officers by the Constitution of this State. All
employees or members of boards having enforcement
or regulatory powers shall take an oath of office.

Section 2. That Sections 57, 159, 160, 19Z and 197 of Chapter
9710, • Special Acts of Florida, 1923, as amended, which have become
an ordinance pursuant to Section 10.01 of Ordinance No, 1830, be and the
same are hereby repealed. - "
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to-be invalid.
Section 4. Notice of the proposed enactment of this, ordinance has
been properly advertised in a newspaper of general circulation in accordance
with' Section 166.041, Florida Statutes.
Section 5. The provisions .of this ordinance shall take effect
immediately upon its.passage.
