2638-82ORDINANCE NO. 2638-82 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ARTICLE III, DISTRICT REGULATIONS, OF CHAPTER 131 ZONING, OF TITLE XI BUILDING AND ZONING REGULATIONS, OF THE CHIDE OF ORDINANCES CITY OF' CLEARWATER, TO ENACT A NEW DIVISION 28, TO REGULATE AND RESTRICT THE HEIGHT OF STRUCTURES AND OBJECTS OF NATURAL GROWTH, AND OTHERWISE REGULATE THE USE OF PROPERTY IN THE VICINITY OF THE CLEARWATER EXECUTIVE AIR PARK BY CREATING THE APPROPRIATE ZONES AND ESTABLISHING THE BOUNDARIES THEREOF; PROVIDING FOR CHANGES IN THE RESTRICTIONS AND BOUNDARIES OF SUCH ZONES; DEFINING CERTAIN TERMS USED HEREIN; PROVIDING FOR ENFORCEMENT; PROVIDING AN APPEALS PROCEDURE; PROVIDING FOR PENALTIES; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on July I, 1982, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the Zoning Ordinance of the City of Clearwater In accordance with procedure as established; and WHEREAS, the City Commission has fully considered the recommendations and report of the Planning and Zoning Board relative to the certain proposed changes to the Zoning Ordinance; and WHEREAS, certain of the proposed changes and amendments to the Zoning Ordinance were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adapted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referr. r.to and considered by the PCPC under sold process; and WHEREAS, the City Commission has authority to adopt this Ordinance pursuant to Section 333.03, Florida Statutes; and 12/9/82 1 I t. WHEREAS, It has been found that an obstruction has the potential for endangering lives and property in proximity of the Clearwater Executive Air Park; that an obstruction may reduce the size of areas available for landing, takeoff, and maneuvering of aircraft thus tending to destroy or impair the utility of Clearwater Executive Air Park and the public investment therein; and WHEREAS, the City Commission does hereby declare: (1) That the creation or establishment of an obstruction has the potential of being a public nuisance and may injure the region served by Clearwater Executive Air Park; (2) That It is necessary In the interest of the public health, safety, and general welfare that the creation or establishment of obstructions that are a hazard to air navigation be prevented; and (3) That the prevention of these obstructions should be accomplished, to the extent legally possible, by the exercise of the police power without compensation; and WHEREAS, It Is further declared that the prevention of the creation or establishment of hazards to air navigation; the elimination, removal, alteration or mitigation of hazards to air navigation; or marking and lighting of obstructions cre public purposes for which a political subdivision may raise and expend public funds and acquire land or interest In land; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section I. A. Primary Zone - An area Ian itudinall centered on a runwa extending feet beyond each en of t nt runway for the most precise a roac existing or anned or either end o the runway. The width of the primary zone is as follows: 50 feet for utility runways having only visua approaches. The width of the primary zone of a runwa will be that widt lbed in this section for the most precise approach existing or planned- for either end of that runway, No structure or obstruction will be ermitted within the rimar zone that is not art o the landing an t?f area an is o a greater hei t than the nearest point on the runway centerline. B. Each violation of this Ordinance or of an regulation, order or ruling promulgated hereunder shall constitute a misdemeanor and be Punishable a fine o not more than Five Hundred Dollars or Imprisonment for not more than one hundred eighty days or both; and each a violation continues to exist shall constitute a separate offense. Section 2. All ordinances or parts of ordinances In conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this Ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The City of Clearwater does hereby certify that the measures contained in this Ordinance are consistent and In conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that some be forwarded to the LPA for their receipt and appropriate action. Section 6. The provisions of this Ordinance shall take effect immediately upon its passage.
