AN ORDINANCE .AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1981, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on February 19, 1981, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of zoning classifications for certain
property annexed into the City of Clearwater in accordance with procedure
'as established; ,and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were approved by
the City Commission after its evaluation of all evidence presented at the
said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(L•GCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by
the Local Planning*Agency (LPA) for conformance with plans adopted pursuant
to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated.the Local Planning Agency for Pinellas County and the PCPC has
adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
. the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property In Clearwater, Florida,
is hereby. classified and zoned as hereinafter indicated, and "The Zoning
Atlas of the' City of Clearwater, Florida of 1981", as amended, is amended
to indicate that fact as hereinafter Bet out:

Zoned ML - Light Manufacturing District
Lots 11 and 12, Block C, Dellwood Heights, as recorded
in Plat Book 10, page 15, of the Public Records oz Pinellas
County, Florida.
AND
Tract'One of H. H. Baskin's Replat as recorded in Plat
Book 23, page 59 of the Public Records of Pinellas County,
Florida, LESS the Seaboard Coast Line Railroad and LESS
that portion'lying within the following described tract;
Begin at the NE corner of the NW 1/4 of NW 1 /4 of Section
9, Township 29 South, Range 16 East, and go S 00.07100" W,
along the East line of said NW 1/4 of NW 1/4, 1334.18 feet
to the SE corner of said NW 1 /4 of NW 1/4; thence go N
89 ° 15' 55" W, along the South line of said NW 1/4 of NW 1/4,
44.92 feet; thence go N 00°01'14" E, 1334.28 feet, to a point
on the North line of said NW 1/4 of NW 1/4; thence go S
89°10'41" E,. along said North line, 47..15 feet to the P. 0. B.
AND
The SW 1/4 of the NW 1/4 of Section 9, Township 29 South,
Range 16 East, LESS the West 210 feet; LESS the portion
platted in Kapok Forest, as recorded in Plat Book 47, page
47 of the Public Records of. Pinellas County, Florida; LESS
the portion platted as Harvard Arms Townhouses, as recorded
in Plat Book 81, page 58, of said Public Records; LESS unplatted
land lying between said Kapok Forest and said Harvard Arms
Townhouses; and LESS the Seaboard Coast Line Railroad.
Together with the Abutting Right-of-Way of S. R. 590.
Section 2. The City of Clearwater does hereby certify that the measures
contained in this ordinance are consistent and in conformance with the City's
Comprehensive Plan and individual elements thereof adopted pursuant to
the LGCPA and directs that same be forwarded to the LPA for their receipt
and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of-such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whale, or any part thereof other than the
part declared to be invalid.
Section 5. Notice of the proposed enactment of thia ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.

Section 6. The Planning Director is directed to include and act out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendment as hereinabove art out.
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
