2583-81j ORDINANCE NO. 2583-81 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1981, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on November 19, 1981, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifications for certain property annexed into the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning'Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by .the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning S -E ORDINANCE .Ord_inance 2583-81 2/4/82 Atlas of the City of Clearwater, Florida of 198111, as amended, is amended to indicate that fact as hereimiifter act out: Zoned CP - Parkwav Business District Commence at the West 1/4 corner of Section 32, Township 28 South, Range 16 East, Pinellas County, Florida, and run S 89°34150'1 E, 100. 00 feet to a point an the Easterly right-of- way line of U. S. Highway 19 North for a P. O. B. ; thence by a curve to the left having a radius of 2964. 91 feet, a chord bearing N 03°04134" W, 296. 75 feet, an arc distance of 296. 88 feet to a point on the Northerly right-of-way line of First Avenue North, according to the plat of Section "A", Unit No. 1, Chautauqua, as recorded in Plat Book 9, page 52, of the Public Records of Pinellas County, Florida; thence S 89°34'50" E, 552. 10 feet along said Northerly right-of-way to a point on the Westerly right-of-way line of Main Street according to the aforementioned plat; thence S 00°01150" E, 1093.45 feet along said Westerly right-of-way line to a point on the Northerly right-of-way line of Third Avenue South of the aforementioned plat; thence N 89°57"0711 W, 185. 04 feet along said Northerly right-of-way line; thence S 00°01150" E, 163.94 feet; thence S 89 °57'071' E, 90. 02 feet; thence N 00 °01150" W, 103.94 feet to a point on the Southerly right-of-way line of the aforementioned Third Avenue South; thence S 89°57'07" E, 95.02 feet to a point on the Westerly right-'of--way line of Main Street according to the aforementioned plat of Section "A11, Unit 1, Chautauqua; thence S 00°01'50" E, 207. 88 feet along said Westerly right-of-way line to a point on the Northerly right-of- way line of Fourth Avenue South according to the aforementioned plat; thence N 89°5710711 W, 39. 10 feet; thence S 00°0115011 E, 440. 00 feet along the Westerly right-of-way line of Main Street according to the plat of Section "A'", Unit 5, Chautauqua, as recorded in Plat Book 18, page 61, of the Public Records of Pinellas County, Florida; thence N 89°57107T1 W 498.45 feet to a point on the Easterly right-of-way line of U. S. Highway 19 North; thence along said Easterly right-of-way line N 00°0015811 E, 1508. 60 feet to the P. O. B., together with abutting right-of-way. AND A parcel of land lying in Section '32, Township 28 South, Range 16 East, Pinellas County, Florida, being more particularly described as follows: Commence at the SW corner of Section 32, Township 28 South, Range 16 East, Pinellas County, Florida, and run S 89°46114" E, 120. 00 feet to a point on the Easterly right-of-way line of U. S. Highway 19 North as deeded in O. R. Book 4400, pages 1741:and 1742, of the Public Records of Pinellas County, Florida, said point being the P. O. B. ; thence N 01 ° 15125'" W, along said right-of-way line 574. 19 feet; thence S 89 ° 4611411 E, 512, 76 feet; thence S 00°00158" W, 574, 00 feet to a point on the South boundary of said Section 32; thence N 89°46114" W, 500.00 feet along said South boundary to the P. O. B., together with abutting right-?of-way. -z- Ordinance '2583-811. 0 Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with, the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3, All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes, Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendment as hereinabove set out. Section 7. The provisions of this ordinance shall take effect immediately upon its passage.
